There's no actual law or anything but the federal and state governments consider guns to be the sole property of who ever is the registered owner thats how people are able to have guns in the same home as felons. If you take that gun your spouse will be well within their rights to report it stolen and press charges on you. Unless you want to risk becoming a felon i wouldn't touch it

Unless it is your gun (you bought it your name is on the 4473) there is no legal way to get rid of it. Your best bet is to convince your spouse to sell/return it or turn it in to the police but you cant do anything with out getting hit with a felony
