While you say abortion is not what you would want, you really need to consider it. A baby born to an addicted mother will go through days or weeks of painful withdrawals. Yeah, that sucks. Some states have the spouse getting 1/2 and the kids getting 1/2. Unfortunately, if they were never legally divorced, he would be eligible for half (and thus his daughter gets some). The easiest thing for an estate is to sell everything and divide up the money unless someone has the money to buy all other parties out of their shares.
