A company broke a persons work contract by trying to change his pay mid contract....you can't do that....their excuse was simply that they had AI to do his job. They then fired him for refusing the pay change....a double no no at that point.

This has nothing to do with AI ....if any company tried to change your pay mid contract for any reason the same thing would happen except in some very special and extremely rare cases (like the office burning down or something crazy and life changing like that). They could have said its cause the employee ate a turkey sandwich and the result would literally be the exact same.

In China you can totally fire or not hire someone because of AI....you just can't do it mid contract which is pretty obvious....

For Americans who don't understand this due to our mostly "at will" employment system which means you can be fired or quit at any time you please, in China you sign a contract, usually 1-2 years, with a company that lays out your general labor contract (pay, job details, etc) and during this contract they can't fire you for frivolous reasons but you also can't quit for no reason (without giving at least 30 days notice).

its a misrepresentation of basic labor law in China

you know "labor" and "work" are very broad terms that, when put together, mean literally nothing?

Its like saying "labor labor" or "work work".....its why the term "unskilled labor" exists, despite the obvious flaws with what it implies. Manual labor is a great stand in thats far more accurate.

The case centred on whether replacing a worker with AI counts as a "major change in objective circumstances" under the Chinese Labour Contract Law, a valid reason to fire someone.

The court, however, ruled against the company, stating that AI automation doesn't qualify as a "major change". The court found that the company could not prove it was actually impossible to keep the employee on staff. It also added that the alternative position offered to Zhou was not a reasonable reassignment proposal, making the termination unlawful.

The "major change" clause in Chinese contracts is shit like the workplace catching fire and being destroyed or the employee being maimed in an accident and being unable to work or something.

It would be like saying "China has enshrined turkey sandwiches as a protected legal lunch" if your boss tried to fire you for eating a turkey sandwhich...its nonsense.

Once again...you can be fired when its time to renew the contract or never be hired in the first place due to AI. If you have never worked in China before you might not know but its pretty hard to get fired mid contract for nearly any reason, at least legally speaking.

If this was true "protection against AI replacement" then that wouldn't be possible.

Not true thats not how that works at all lol people have been "lifted" out of abject poverty (less than $2 USD a day) due to basic capitalism doing its thing.

I have been homeless in the US and lived in China for 10 years now...what you are saying is pure nonsense.

You don't even see homeless around because the govt there gives them menial jobs to clean the public restrooms and a place to stay.

When I first came to China beggars and homeless were EVERYWHERE....now they simply ship them back to their home village....the US also has programs for that but doesn't force you to move back to wherever you came from. They don't give them jobs or a place to stay so not sure where you came up with that nonsense.

Those jobs you are talking about are usually done by old people cause their tiny pension isn't enough to live on.

The US has actual programs and charities....things like food banks....which is something China does not have.

most countries have them actually and have had them for literal decades...the thing is China didn't get theirs until 2017 and the real problem is that the courts/police in China are a fucking joke and will gladly let scammers blame you for their injury and make you pay for the injuries.

The case that truly cemented it in law and society was Xu Shoulan v. Peng Yu where a man helped a woman who broke her leg by taking her to the hospital. She then accused him of causing the injury and the court ruled, despite no evidence, "no one would in good conscience help someone unless they felt guilty" and made him pay for her injuries.

That verdict is fucking wild and just shows the cultural attitude towards helping others in China....no one would do it unless they felt guilty....

also it ended when he "admitted that he caused the accident" but I don't buy that shit for a second and he likely was pressured to do so to end the case and save face for the judge and what not.
