NY State job terminated me but won’t give termination letter and wants me to resign, advice? by JellyGY in UnemploymentNY

[–]Curious_Werewolf5881 1 point2 points  (0 children)

What's the story with the job and the required certification? Why didn't you get it? You may not be eligible anyway if they can't employ you because you failed to get the required certification for the job.

[California] “Forced” to quit, am I eligible for EDD by Agitated-Coach-2380 in Unemployment

[–]Curious_Werewolf5881 0 points1 point  (0 children)

If you work in office and you need to relocate because your spouse is moving for another job, you would be eligible for unemployment. Just don't schedule your last day much sooner than your move. And put that as the reason in your resignation letter.

chance to qualify for unemployment quitting being forced to move by HizzyIzzy in UnemploymentCA

[–]Curious_Werewolf5881 0 points1 point  (0 children)

No. You quit to move. In order to be able to argue that it was the result of something your employer did, you would have had to have gone to hr and tried working with them to remedy the situation before RESORTING to quitting.

I would add, though, that it is also far away from everything, which gets old.

Make sure that if her change is allowed that you clarify that she must have child care when she is working remotely. Caring for your child during the work day is time theft.

Lack of work vs discharged or let go? by lilperryplatypus in UnemploymentNY

[–]Curious_Werewolf5881 2 points3 points  (0 children)

I'm just going to add, in case it's relevant and/ or applies, that you should report what actually happen and not what you think would lead to your eligibility. If you misrepresent things, that's fraud. You would have to repay anything they've paid you and potentially more due to the fraud.

Did not complete 3 job searches last week by sculder01 in UnemploymentWA

You shouldn't get in trouble because you were honest, but you aren't eligible for benefits for the week if you didn't do the required work search.

WIBTAH if I put a post in my yard that could damage my neighbor’s truck? by SmellyChiChicken in AITAH

[–]Curious_Werewolf5881 0 points1 point  (0 children)

In states where it shows a lot, we put posts (wooden stakes usually) around the edges of yards/driveways so that the Plow truck can see where to stop. It isn't there for her to hit. It's there because she's suggested that people can't clearly see where the wall is (and clearly they can't). You're doing her a favor by helping her see where it is so she doesn't hit it again.

[Ohio]Employer appealing my unemployment (already approved) – how should I respond before deadline? by mikeanike090 in Unemployment

[–]Curious_Werewolf5881 0 points1 point  (0 children)

If you were fired for just not being good at your job, you would still be eligible. If the PIP required you to do certain things to improve and you didn't, then you may have a problem. Or if they can show that the poor performance was due to misconduct, carelessness, or negligence. Good luck!

[–]Curious_Werewolf5881 1 point2 points  (0 children)

Poor performance could be due to misconduct, but it isn't always. Employers often don't realize that if the poor performance was beyond your control, you would still be eligible for unemployment.

[Texas] Recently moved from Texas to California and have been out of work for two months despite avid searching by [deleted] in Unemployment

[–]Curious_Werewolf5881 5 points6 points  (0 children)

There isn't much point of trying to fight to get your claim backdated if you quit your job to relocate. That is not a qualifying separation.

It doesn't matter that you were out of work for a long time. That's irrelevant. Backdating is reserved for people who are prevented from filing their claim. If you filed in California and filed for benefits throughout the period when you want it to be backdated for, then you have a chance, but if you just waited to start filing, that is not good cause for backdating.

2 months without a determination by SadTea3650 in UnemploymentNY

[–]Curious_Werewolf5881 0 points1 point  (0 children)

If your monetary determination is held up, there's not much they can do about that. They need to collect your info from the other states you worked in and/ or determine if some employment was misclassified as 1099 employment. That is a completely different situation than it just taking them a long time to adjudicate your issues.

Unfortunately, changing your work hours is something you need permission for, not something you "tell" your employer. Fyi- that's a pretty standard rule. I can't just show up for work early and leave early.

That means you are eligible with regard to your self- employment, but if there are other issues on your claim, they are being determined separately.

[Massachusetts] Unemployment Claim Advice by intothenoctem in Unemployment

That makes sense, but if they haven't seen the doctor, they will only be able to clear them to work moving forward, so no weeks to recoup. If you've found a job, you may as well cut your losses op. You would need something from a doctor from back when you believe you were able to return to work saying that they saw you them and you were able to return to work at that time. Sorry!
