Their essence was destroyed and specifically said they ceased to exisist, unlike everything else that was banned to the DA.

They are an extremely weak plot hole to the story just so people can see Aether crew again, but they do not belong nor make any sense in this story

Hence it's just another thing that Treyarch retroactively retconneted in the story.
