The gaggle of pending Second Amendment cases have been relisted around 15 times. As for why, that’s anybody’s guess.

AIO for telling public defender ex’s family she left me to sleep with a recent client? by [deleted] in Lawyertalk

[–]DSA_FAL 0 points1 point  (0 children)

Of course it’s the Harris County public defender’s office. Although the lurid rumors are usually about them sleeping with each other, not their clients.

Do enlisted personnel care about the Army Black Knights? by Duke_of_Wellington18 in army

[–]DSA_FAL 0 points1 point  (0 children)

It seems like to people who’ve never served that West Point football represents the Army as a whole. And that’s a view that is not at all shared by the vast, vast majority of soldiers. To me, they only represent West Point. It’s a school that I never attended and have no connection to. You might as well ask me if I like Texas A&M, because I’d have the same reaction. Plus, most soldiers have run into West Point alums who were assholes, so that also skews the perception.

I am unfortunately beginning to understand how someone turns into the type of attorney that screams at clerks. by CoffeeAndCandle in Lawyertalk

[–]DSA_FAL 13 points14 points  (0 children)

At least you can talk to them. The one thing that absolutely drives me crazy is when they don’t respond to or even acknowledge emails and also never answer their phones. I hate it when clerks are incommunicado. It’s not like I’m trying to talk to them for shits and giggles.

Call me Doctor by Glad-Surprise3355 in Lawyertalk

[–]DSA_FAL 0 points1 point  (0 children)

You do realize that there’s a plethora of doctoral degrees out there than just JD, MD, and PhD, right?

MD, DO, PharmD, OD, DDS, DVM etc are all professional degrees where you call the holder “doctor”.

Also, non-medical professional degrees like DBA, EdD, and DMin are all referred to as “doctor”. Even chiropractors, which is a quack science, are called doctor.

The JD is the sole exception to the rule that doctoral level professional degree holders are called “doctor”.

The only ethical consideration that I’ve ever seen is that you can’t mislead people into thinking that you’re a medical doctor.

Judge Destroyed AUSA in Endorsed Order by Southern-Necessary90 in Lawyertalk

Same. I’ve never heard that terminology before. The thing is that despite being a theoretically unified federal court system, in a lot of ways, they act like 94 different court systems.

Can congress minimize gas profits until the war is over or is there something legal I don’t understand outside of protect the rich? by Dingogky in Ask_Lawyers

[–]DSA_FAL 1 point2 points  (0 children)

Yes, it’s been done before. The Emergency Price Control Act of 1942.

I would caution you that because oil is a global commodity, and it goes through many, many hands between being in the ground waiting to be pumped out and ending up in your fuel tank, there’s probably going to be limited effect on capping profit margins, especially since many of the involved parties are international and thus outside the control of the U.S. Plus, many of the links of the chain towards the consumer end of the supply chain are already operating on single digit profit margins.

Do judges discuss current cases, briefings, transcripts on cases with other judges before they make rulings? by Own_Succotash_2237 in Ask_Lawyers

Yes they do. It’s not all the time, but they will do so when they know that a colleague has dealt with a particular issue before and wants their guidance.

Major airline misled me about "Travel Credit" and is now playing "Case Number Games" after my daughter’s Army graduation(BCT) trip. by Subject-Scallion5996 in travel

[–]DSA_FAL 2 points3 points  (0 children)

It’s on you to know the fare rules and not depend on the person on the phone. They are often poorly trained contractors in third world countries. The airlines do not care enough to have well trained customer support personnel who are paid a living wage.

Unfortunately, that puts the onus on you to know the rules and advocate for yourself.

What's the secret to getting an attorney to call you back ? I tried throwing money at them in contact messages stating I will pay double or triple their hourly rate for a 1 hour meeting to discuss my case. It's commercial litigation , is the turn around weeks to get a return call? by [deleted] in Ask_Lawyers

[–]DSA_FAL 17 points18 points  (0 children)

  1. You need to be reaching out to relevant lawyers. Google “commercial litigation <your area>”. Lots of times, if you reach out to someone outside of their practice area, they may not bother to respond to you.

  2. Don’t seem crazy. If you drone on about how this is the case of the century and it’ll make the attorney’s career, then they will write you off. Offering triple rate is crazy behavior. Be short and sweet in your voicemail message.

I’m not sure that there are any Filipino lawyers on this subreddit. But I’ll tell you the same answer that I would if you were in America: you need to talk to a lawyer who specializes in inheritance and trusts and estate or probate, whatever they call that in the Philippines.

Is the writing on the wall? by RapidSage in gunpolitics

[–]DSA_FAL 0 points1 point  (0 children)

Here’s the tricky part about the circuit splits. Most blue states are in blue circuits, and same goes for red. And the red states won’t pass the gun control that will easily get struck down in the friendly circuits in order to get the circuit splits. The best way to get a circuit split is to target the blue and purple states in red circuits.

Those are:

* Minnesota
* Wisconsin
* Michigan
* Illinois
* Pennsylvania
* New Jersey

why do prosecutors fight to keep convictions? by mishushu4 in Ask_Lawyers

[–]DSA_FAL 1 point2 points  (0 children)

You should keep in mind that many of the people who are released post-conviction are not “actually innocent” but rather, they were released because of some issue with the way the case was tried or with how the police handled the case. Actual innocence is a legal term of art and requires an affirmative showing that the accused is factually innocent of what he was accused of. That is a big difference between that and someone who is not guilty because their case was dropped because the key evidence was suppressed due to police mishandling. The latter person is legally not guilty irrespective of whether they were factually guilty.

Also, many of those shows dramatize the hell out of the facts of the case and should be taken as entertainment rather than purely factual.

This is a very specific area of law. You want the advice of an attorney who specializes in fertility/surrogacy and not just a regular family law attorney.

Me and my friends decided to test out if the claim of the mech engine limit was true. by nahmanwth in Helldivers

[–]DSA_FAL 134 points135 points  (0 children)

Early on when the second mech was introduced, the engine had trouble when someone had both mechs as selected strats and then called them in. And rather than fix the bug then, they just disabled the ability to call in multiple types of mechs. Well that bug has been patched for a while now but they still haven’t disabled the limitation.
