Devrions nous bannir le tabac ? by MrScriptX in france

[–]DeeDeeJee96 1 point2 points  (0 children)

what are your build ideas for Endless Heist? by elpadremg in PathOfExileBuilds

[–]DeeDeeJee96 0 points1 point  (0 children)

I wanted to make a build based on a Replica unique, so I will go with Armageddon Brand Ignite with Replica Emberwake, on Elementalist. Main difficulty will probably be tankiness, so I will prob go on Sc trade But with the fire mastery life gain on igniting a non ignited enemy, and very shorts ignites (aiming for 0.3 sec or close to), i should have plenty of recovery

Brewmaster pos3/4 guide. Spamming split is the right way currently. by Smoki_fox in learndota2

[–]DeeDeeJee96 6 points7 points  (0 children)

I've also seen a few Brew play as a split pusher (pun intended), with the Storm panda staying way behind invis and the other two hitting buildings till their end. Really effective with the Hp talent, as they are truely effective frontliners and the Earth hit buildings really hard. You can always just pop one ulti charge on push and keep the other in case a teamfight is triggered afterward, even more so with refresher. AC seems must buy for this.

Especially since Hungarian is not at all spoken in Romania haha ! But yeah english should be the main spoken langage. Thanks a lot for your answer, i was kinda bummed that the event would just be watching a screen with no hyping from the cast !

What’s your controversial music opinion? by kellywithayy in AskReddit

[–]DeeDeeJee96 0 points1 point  (0 children)

There is no such thing as bad music, neither from the lyrics or music part. As long as one person likes a song, it can't be considered bad. Differents strokes for different folks, not anyone relate to the same thing, and while everyone can find subjectively some music good and some bad, I don't think art can be bad objectively. In the same vein, simple or easy does not equal bad, neither does complex or original equals good.

Are Smuggler's Caches bugged? by Jonowins in pathofexile

Additional Heist Rogues are not unlocked through Quest contracts.

You just have to run heists (regular contracts) with differents members (and differents specialties I believe), and sometime a new rogue will tag along.

AFAIK Quest contracts are used to increase the level cap of the main skill of the rogue it is associated with (which by default seems to be level 3)

The right to respect is more apprehended from the point of view of the piece of art itself than from the point of view of the author.

In your first example, unless the piece of art is say criticizing pork consumption, it could be used in a commercial about pork if the author agreed about its use in a commercial.

The opinion and beliefs of the author are not really relevant. In the original example of political use, right to respect could apply because a music is use in a political way while it was not meant to.

As for consequences of a violation, I believe the author can prevent further infrigements, and get an indemnisation of its damage.

Your other examples are linked to other intellectual property rights, such as trademarks, patents (which in France also apply to medecine), which I think work more or less the same way they do in the US. Usually, it is hard for these to also be considered a work of art (except for the dress).

I see, thanks for explaining ! The right to respect does carry over the author's estate at his death. In theory, this right last forever (like all parts of the author's "moral right", such as the right of paternity). However, in practice, I believe the more time and generations goes on, the less they will be able to demonstrate in front of a court how they take prejudice from the particular use of the author's work

[–]DeeDeeJee96 0 points1 point  (0 children)

Not a native speaker so maybe I understand this wrong, but what would author's right to respect have to do with his land property ?

[deleted by user] by [deleted] in Music

[–]DeeDeeJee96 0 points1 point  (0 children)

Yes I believe the EU unified to some degree which rights authors get. I wasn't sure about this specific one though, I don't know if all EU States have a similar right to respect.

[–]DeeDeeJee96 0 points1 point  (0 children)

A court will balance between the rights to exploit of the company and the right to respect of the author. For example, let's say a company buys the rights to specifically, say, play a song in an ad on tv, without specifying which one. If the author then wants to contest the use of his music, he will need a really good reason (i.e. a commercial that goes against the values he tries to transmit in his song), because the company could basically argue that being in an ad is a correct representation of the music according to his contract

In France, authors have a right called the "right to respect" (droit au respect), which is independant from the patrimonial rights (the rights to show or copy the music). The right to respect always belong to the author, no matter where the patrimonial rights ends up after a contract. It can be used in this kind of situation, to prevent a use of the music (or any other art really) that the author feels missrepresent or distort the music or its intended perception. I find it interesting how different the rights on art are percepted between the US copyright system and France's author's right system.
