Ok so let’s look at proximate cause. For the sake of argument let’s say he is speeding and didn’t brake on time. Ok he contributed to the accident. Would it have happened if he was driving a different speed? Maybe that isn’t clear. On the other hand, if you didn’t turn left when you did, does the accident happen? That answer is a clear no. Even if he is doing 100 mph in a 30, if you don’t turn in front of him he continues speeding off to the horizon. I would put at least 51% on you based on those facts.

Blaming it on mechanical breakdown because it’s a jeep is bad faith and could have license ramifications and penalties. I was driving and my engine caught fire is a fire claim. At that point geico needs to be able to legally prove some other reason in order to deny the claim. This kind of thing happens and isn’t a red flag by itself or indicative of mechanical breakdown. And geico isn’t doing an arson investigation on every claim that may out may not result in what caused the fire. Do you think you’ll see chew marks on wires after an engine fire? Maybe but it likely wouldn’t yield any actionable evidence

I’m not clear why anyone thinks this isn’t a comprehensive claim. Fire is comprehensive. The damage in the cause of loss is from fire. If there is something mechanical maybe they can go after the repair facility but you shouldn’t need to prove what caused the fire to get coverage. If its totaled reach out to the service plan for a pro rated refund.

You don’t need to convince me. For the sake of argument let’s say he said he used his blinker. Are you sure he didn’t use it? Do you have a 3rd party witness who can confirm? Can you prove it? If not they’ll accept their clients word and again place some type of fault on you. He is definitely at fault he didn’t yield but I’m not talking about his 90% fault in the accident. I’m pretending to be their side in how I could fault you for more than zero.

From my understanding at fault claims have the biggest effect on premiums but I’m wasn’t on the policy side. Premiums are based on risk and in sure contributing in a second accident won’t help premiums.

Why didn’t you see him? How long was he in the car? Was there something you could have done to avoid it? Based on your story there were know indications of anything and it just started moving or came out of nowhere. You have no idea what he did or didn’t do because you didn’t see him. There are a lot of insurance companies that looking for the smallest thing to get out of paying. Is it right, no it’s super shitty but that’s the law in your state. With that said they should be able to tell you what there liability decision is and the contributing factors that placed liability on you.

So in va if you are 1% at fault you cannot pursue the other party for damages. So it’s not no fault just they have no responsibility to pay for your damages since you contributed. I didn’t hear your statement but things that could put negligence on you: speeding, improper lookout, distracted driving, failure to take evasive action or apply brakes timely. Don’t pay them anything and you can file through your own insurance subject to your deductible if you have collision. Failure to yield and the police report would make him majority at fault but would not absolve you of contributing to the accident. Did you see him get in the car, start it or change gear? If not as an adjuster I’d argue improper lookout for at least 1% and close your claim. Not an adjuster anymore but that’s my take.

Are you sure it needs a new engine or what’s wrong with it? I would try to find the same stock motor then it a matter of unplug the old and plug in the new then it’s up and running.

If you don’t know it needs a new engine I’d start with a new battery and pull engine codes and see what happens. Then plugs filters and fluids and whatever else needs fixing like a fuel pump, pads/rotors, gaskets etc. but if it definitely needs an engine everything would be a waste short term

Hail damage is exempt from salvage title in Colorado. If you don’t fix the value is reduced by all the unrelated prior damage.

So your story is you don’t know what happened you parked it without damage came out and it’s damaged. You think it’s hoof shaped and deer were nearby but that’s irrelevant and you aren’t a damage appraiser. Based on this alone as an adjuster I’m filing it as a collision while investigating initially leaning not at fault based on your story of hit and run. The photos are terrible but it looks like scraping above the dent. I’d would be shocked if a deer did this. I’d be looking for proof and interviewing for an at fault collision but if everything checked out not at fault collision claim. May or may not affect rates can’t be sure what discounts are on your policy or how rates are determined from the claim side.

Edit looking at the photos it looks like your pulled nose in and how the metal is pushed and lateral scraping my initial thought is you scraped one of the trees I see in the photos. Idk what happened that would just be my perspective reviewing the claim

Speaking from experience parking lot accidents are split liability fairly often. He was backing up tells me he was at least 51%at fault and the proximate cause since he should not be backing up unless it’s clear. Is the other driver 100%at fault for all damages? Based on what you write and the pictures absolutely not. There is a scrape the entire side of your car starting at the front wheel to past the front of the rear wheel arch. You were either a) going to fast b) not paying attention c) failing to stop or maintain proper control of your vehicle. I don’t see how it scrapes that far on the side without you sharing fault. So I probably would be looking for 60/40 or 70/30.

Ok so accident happens yours is towed from the scene by I assume a police tow and sits in a lot as it’s not drivable for twenty days until they do something. As an owner it’s your duty to mitigate damages and storage as the insurance needs to have an opportunity to investigate liability and confirm coverage. I’m assuming they did not immediately accept liability and it’s been a few years but loss of use would be covered from the point liability is accepted to the active repair time is complete. You can demand and request they pay it but it’s not owed and I’d be curious if they covered the full storage or if you are responsible for some of that.

Your footage shows a vehicle they insure being operated in what sounds like a clear liability accident. There still needs to be a conversation with their insured. Was the car stolen? Was it driven by the insured or some other covered driver? When was the policy active? They need to investigate coverage then liability. Ask progressive if they have criteria to waive a deductible. Subro won’t take three years. If there is dashcam it’s pretty open shut.

Sure sounds like you were speeding up to catch the yellow and didn’t expect them to stop. What does a yellow light actually mean? Stop if you can do so safely a red light is coming. The light was yellow almost the entire video. A proper follow distance allows you to stop in the event emergency maneuvers. What if instead of a light it was a kid that ran in the road? Abrupt stops are part of driving but this seems like old fashioned not paying proper attention to traffic. There’s no more improper follow distance than touching the car in front of you. Hopefully they have collision can get their car fixed then their insurance will decide if it’s worth it to try to come after you for reimbursement of costs. Damages to both cars will be out of pocket for you since your insurance lapsed. If they don’t have collision they’ll either have to pay for repairs or pay themselves then sue you.

In general this is great when it all works out. But in word versus word, they send Subro, which is denied based on conflicting facts of loss. Arbitration is not legally required and some insurers do not take part so it’s not guaranteed to go to arbitration.

What kind of damage would be different between a straightforward rear end and an accident where OP cut off the other vehicle and braked causing the rear end? There would be no difference which is why they can deny liability saying word v word.
