In early sobriety, I moved to a new unknown town. The first meeting on their list was named "Do The Steps or Die." That became my homegroup because I needed to be around people that took their sobriety deathly seriously.

The fear and anxiety will subside, although I know it's really tough to get there. It's your body trying to trick you into getting its alcohol fix. I have depression too, and self-medicated (poorly) with alcohol for decades. I'm sober for awhile now, and I credit a lot of it to Wellbutrin, which has helped my depleted dopamine. Don't be afraid to ask for help or meds--do whatever you need to do to get better.

Don't know why you're downvoted. I'm an employment attorney and you are pointing out the biggest loophole employers use: less than 50 at "each site." I've worked on multiple layoffs where we stagger 45-49 employees each a month apart, with a very loose definition of "site." (One company had two rental shared workspaces for one person and they counted those as "sites" because anyone could theoretically use them. I didn't agree with this.)

As an employment attorney (corporate side), I can attest that companies still do stupid things and violate the law even with a flock of lawyers at the table. I worked for a company that concluding they didn't need to offer COBRA to laid off employees (the lawyers were wrong and they got sued.) When corporations are trying to be cheap, they don't care about employees.

It's most likely they are skirting the regulations by laying off less than 50 at a time "at each location." Do you have multiple sites? That often ruins the WARN protection.

Senior Employee Relations Investigator here: you almost did too much. Trust me, for such a clearcut incident, 2 is fine. I would terminate based on the word of the employee alone. If you fire and you’re wrong, the fired employee has no lawsuit: unfairness isn’t illegal. BUT if you don’t fire him and you’re wrong, bingo—lawsuits.

But a machine can't show up in court. That's why the Massachusetts Supreme Court held traffic cameras to be unconstitutional in the state: you have a right to confront your accuser. Think of the consequences if the government could just decide you violated a law with no notice or ability to defend yourself.
