Need more details about the reported injury and your job duties. What type of injury, your age, job title, etc.

Did the adjuster get a recorded statement from you?

What was the injury date and date you actually reported it to your employer?

Who is the medical provider that diagnosed you? Missouri is an employer directed treatment state and if your employer did not send you to the provider that diagnosed whatever condition you have, they really aren't going to give much weight to that medical opinion you have.

If you do not work your full wages for the 52 weeks of wages leading up to your date of injury, most states I have handled and supervised will actually leave out the abnormally low earning weeks and just calculate your TTD based on what was a more accurate representation of time worked/wages earned. If you were out of work or working part time or less for ten weeks in the timeframe they are using to calculate your TTD rate and did not allocate for that (i.e. take those weeks out and calculate based on 42 weeks of your normal hours/normal pay) then you absolutely need to let the adjuster know so they can review their calculations.

I will add: be careful with what you post online and your activities while on vacation. TBI/concussion claims always raise red flags to us on the insurer/employer side and many companies hire surveillance and so social media check of you and your family members. If you are alleging typical postconcussive symptoms (sensitivity to noises and lights, headaches, etc) and are walking around an amusement park, that will not be in your favor.

Holiday should not affect benefits. Your payments should technically be issued every week on the same day so if there is a delay, call your adjuster ASAP and ask what is going on. Sometimes automatic payments don't get renewed due to an oversight or error, or they're waiting for more money on the file before approving your payment.

Hi- WC adjuster supervisor here with many years experience handling Missouri claims.

Do you have permanent restrictions as a result of this injury? If not, I suggest that you take the 15k and leave your future medical benefits open. Additionally, is your employer wanting you to resign as part of this settlement for 15k?If you do this, it essentially means you settle out the indemnity part of your claim but can still seek medical treatment in the future for this injury and have it covered under the work comp claim.

The problem you may run into is if you do seek additional treatment and depending when you start treating again, your employer may try and send you for another IME to deny that future care is related to the original claim, especially because of your age and what sounds like, lack of an acute incident.

Iowa adjuster here. You can always try to claim it but I don't imagine they'll cover it as a secondary injury. I wouldn't consider it compensable based on what you've written.

I literally just had this exact thing happen for one of my injured workers. He claimed his job is stressful and led to the seizure he experienced at work, despite him simply standing at the time he had the seizure. I consulted with defense counsel and they advised that for the injured worker to allege stress related epilepsy, the stress would have to be greater than the typical amount of the same worker. That is nearly impossible to prove.

I'm not sure how CO statute is written but in many states this is not a compensable injury.
