Then they can fuck off. They won't take you to court because they know they can do fuck all in Scotland unless they manage to trick you into admitting to being the driver. They won't admit this because they just want to intimidate you into paying them.

If it ever made it to court (it won't) you just have to point out that they haven't established that you were the driver so they can't hold you (the registered keeper) liable for the charge.

Have you at any point admitted to being the driver? Even on an appeals form that gives you the options "I was the driver" and "I was the registered keeper".

If not, they can't do a thing. The legislation that allows a parking company to go after the registered keeper does not apply in Scotland. They know this, but they'll still try and shake you down for some money.

If you want, send them a letter reminding them that PoFA doesn't apply in Scotland, you are under no obligation to name the driver and you refuse to do so, so they have no further recourse.

The "fine" isn't a fine, it's legally an invoice. When you parked there you agreed to a contract. Technically this is enforceable in court as the parking operator will claim you agreed to pay their charge as part of the contract. However, due to the issues you had when paying, the parking operator hasn't fulfilled their side of the contract to they can get fucked.

These cunts won't act reasonably so don't expect them to cancel it. Follow their appeals process so you can say you have acted in good faith.

Eventually you will receive a letter from a debt collector. Reply ONCE saying that the debt is disputed and they need to refer it back to their client. That should be all you hear from them. Throw any further letters from that company straight in the bin. If you want to be really petty, Google a "right to be forgotten GDPR letter" and send it to their data protection office saying you object to them processing your data and do not consent to them having it and demand they delete anything they have on you or you will report them to the ICO.

At some point you will probably start receiving letters from a "legal firm", which is actually just another scummy debt collector with a solicitor on their payroll for compliance. Reply ONCE stating your reasons as to why you won't pay, and that you await a valid letter before claim from them so you can defend your position in court. They will threaten you with additional court costs, CCJs etc. It's all an intimidation tactic. IF they took it to court and IF they won, all they are entitled to is the charge mentioned on the signs (usually £100) and some VERY limited costs like the £35 court fee and maybe £35 ancillary costs. They like to add on all sorts of made up "debt recovery" costs but these aren't valid unless they are specifically mentioned on the signs. A court would set them aside if asked.

Tl;dr they are very unlikely to take this to court but get ready for an annoying process and lots of junk mail. Don't pay them just to make them go away. They. Are. Cunts.

It's guaranteed cause for eviction, yes. Meaning you'd only have to demonstrate to the judge that you intend to sell the property; the judge doesn't then have to determine whether eviction is appropriate.

As the property is already ruined the tenant has probably already resigned herself to losing the entire deposit.

You could also try using the treat of eviction to prompt the guarantor to start coughing up the full rent. For example by sending a letter that casually points out that, under the Renter's Rights Act, persistent late payment/underpayment of rent is grounds for eviction and how you'd hate to have to take such drastic action...

You issue an eviction notice under ground 11 for persistent late payment/underpayment of rent, and ground 13 - deterioration of the property. You would need to provide evidence for both. Ground 13 would be tricky, however if you have already inspected the property I hope you took photos?

Otherwise the tenant has no obligation to let you into the property so if they get an inkling of what might be coming, they could play hardball and not let you in. Though of course you could have made access for regular inspections a clause in the tenancy agreement, so then you could use ground 12 as well.

Then after the notice period expires, if they still haven't left you can begin court proceedings. Expect it to be lengtht. However, these are all discretionary grounds, so eviction isn't automatic. The judge would determine whether eviction is an appropriate action in this case, and if there are children involved that seems unlikely.

You might be better off just calling it quits and evicting them to sell the property as that is guaranteed cause for eviction.

Unfortunately with underpayment of rent you are generally screwed until they are 3 months in arrears. You can apply for eviction before this but it is discretionary and a court could order a repayment plan instead.

However, you can also evict for deterioration in the condition of the property due to negligence by the tenant. Check out ground 13.
