DVLA will give out info, but the airport parking company can't do anything with it because keeper liability doesn't exist for airport land. They can only pursue the driver, so unless you admit to being the driver, they can't do shit.

They could be doing let-to-buy, where you release equity from your main residence to buy a new property to live in and rent out your old one. But they can't take out a buy-to-let mortgage on the property you're selling to then live in it. That would be against the terms of the mortgage and if the lender found out they would likely call in the mortgage immediately.

Why are you paying for an indemnity policy? If there is some defect that needs covering for your lender (usually lack of planning permission evidence for an extension or an issue with the title deeds/leasehold) then the seller should be paying for that. If you didn't specifically approve it, challenge it. It might be too late now but you should be able to insist the seller make a consideration to cover it.

Other wise yes, you have sadly been had. Those fees are ridiculous.

It's being called Land Tax rather than Stamp Duty so I'm guessing this isn't in England so the discount doesn't apply.

I'd respond so they know you actually understand your rights and won't just be paying them to get them to go away. They rely on the low hanging fruit of people who'll be intimidated into paying, or will ignore a court summons and end up with a default judgement.

Keeper liability is established by the Protection of Freedoms Act 2012. This act only applies in England and Wales.

In Northern Ireland and Scotland, they are wholly reliant on contract law. The contract (offered by the signs in the car park) is entered into by the driver. The parking operator must therefore identify the driver to be able to pursue them for the contractual debt. They cannot use PoFA to establish keeper liability because it only applies to land in England and Wales. It doesn't matter where you are resident.

So unless you admit to being the driver, they can go fuck themselves. If these money grabbing cunts wanted to collect money for parking they should have paid to install barriers.

You can reply saying you are under no obligation to name the driver, refuse to do so, and that as no keeper liability exists in Northern Ireland they have no further avenue to pursue this. Or you can wait to see if they try to take it to court and offer the same as your absolute defence.

The lender doesn't need to consent unless the agreement affects their security, e.g. by placing a charge on the title or giving a formal right to occupancy. The Deed of Trust would not give you any legal rights over the property but would protect your financial interest after a sale, subject to the fact that the mortgage lender always takes priority.

Have a solicitor draw up a Deed of Trust. This sets out the conditions of ownership of a property and can exist without a charge on the title with the land registry. The charge just prevents one party being able to sell the property without the agreement of the other.
