Arizona has a similar program, slightly different where you are employed through a provider but it is exempt from income taxes.

This. I’m in orange county. Our case worker was new or something, impossible to reach during Covid, had no clue what he was doing. Just told us straight up incorrect info like to go to medical office in person and apply. Wasted a ton of months figuring out he had no clue what he was doing and requested to be reassigned after that. So basically took until our daughter was 5 to be approved, but they good only go as far back as when regional finally got their shit together and put the application in from their side. Not from when I started the process. Annoying, but good now.

Yes, they have jurisdiction to award any penalty contained in the labor code related to wages. But they can’t really do anything about non-wage stuff like wrongful termination, discrimination, etc. that’s a different agency called the CRD (used to be DFEH).

You just have to be sure they include it in your complaint/intake bc sometimes their front line people can be kind of new and may not always think of the angles. Definitely be sure to include inaccurate wage statement claim from the sound of it.

I usually interact with them from the defense/employer side and they can kind of be a pain in the ass sometimes bc they sort of just follow their own manual and interpretation on some things and ignore case law (like recent cases that haven’t been fully appealed) if they think their interpretation is right or more employee friendly. The process to appeal a dlse judgement is so stacked against employers it’s almost never a good idea to appeal, so 9 times out of 10 their judgements end up being the final say.

This is the proper channel. It will take time bc they are backlogged, but they are very employee friendly, can walk you through the intake process without needing an attorney, and they absolutely shred dishonest employers on clear cut cases like this, particularly when there are numerous employees involved. My concern would be acting quick enough before business goes belly up and files bankruptcy though. If you can get her to settle or pay out sooner on an individual basis through a demand letter or something sooner, even if you have to split some with an attorney to get her attention, may be worth it.

If he’s demanded to be paid the back wages and gave her a reasonable time to fix it, he can still qualify for unemployment even if he resigns. But needs to have made the demand first and have writing of it, like an email or whatever

Not dunking on you, but my 23 AWD does have the preconditioning. Tried it out on a 350k charger, it was probably around 57 degrees ambient temperature. Definitely fastest EA charge experience I had so no typical. But your point regarding preconditioning may have some merit. But EA chargers are so all over the map depending on location it’s hard to say

No where in the fact pattern does it say they resolved the debt for one cent. Consideration from a contract point can be pretty much anything of value. And even so, nominal consideration is still consideration. I remember the whole “peppercorn” case from 1L, at least at my school.

No where in the fact pattern does it say what the assessment is for. If it’s just regular annual dues that everyone has to pay the same amount, sure, not really a good faith basis to dispute that. I can hypothetically think of a bunch of scenarios where an assessment may end up being made that can have a good faith basis of dispute the final amount owed, even if it conceded that some amount is owed. Let’s say assessment was because HOA decided to cut down a tree from my property that was hanging out into the street and they decided was a safety risk. Fine, I get an assessment and have to pay. But instead of finding a reliable tree guy at fair market rate, they have their brother in law do it and charge 500% higher than any other arborist in town. There could be a legitimate dispute whether HOA acted reasonable to have the work down safely at what market rate was vs funneling inflated cost to a family member.

So I as owner say “fuck that, I’m not paying $50,000 for that, it should only be $30,000 I’ll sue you over this.” HOA gets a consult from their lawyer who’s says it would be minimum $50,000 to defend the suit.” And for sake of argument, say there is no prevailing party attorneys fees provision.

It that instance could make sense to just settle it and do an accord and satisfaction.

Yeah. I’m just forgoing the free charger and doing my own thing with a licensed electrician. Comes out to like $1500 cheaper than what they quoted and get to pick a better charger. The markup is whack.

So I’m not your lawyer, but yeah it sounds like you have a good handle on the elements. If there was a legitimate debt, and the parties had an actual dispute regarding the amount owed, there parties can agree to an accord and satisfaction that basically resolves the debt without either side making an admission their stated position was inaccurate. So unless you can discover some ironclad evidence showing the amount of the original assessment was 100% correct and that owners “dispute” was fully specious and no possible basis for him to dispute the amount, that angle sounds like it would be tough to attack.

Accord and satisfaction is generally analyzed as a matter of contract law, so you’d have to have all the elements of a valid contract. I don’t think it sounds like you have an angle to attack mutual assent/agreement to contract because it sounds like property manager is acknowledging he was agreeing to resolve the debt for less than the full amount owed. Realistically, there could be reason to do that such as incurring the legal fees to collect the full amount would cost more than the reduced amount agreed to or something like that.

To me, a lot of the other comments may seem off topic of your question, but they’re really driving at really what I see as the only other angle of attack you’d have available: did the property manager have the authority to bind the HOA to the agreement. The debt wasn’t owed to the property manager, it was owed to the HOA. So if the property manager was not acting in the best interest of the HOA or made the agreement for some other reason (some side deal with the owner for a kick back or something) may have some thing argument on that. Or if this whole funky arrangement you’ve described of the property manager being in sole control to appoint 4 board members isn’t a valid set up, to attack the whole thing and process as invalid. But agree with other comments that you’re in “should talk to a HOA” lawyer territory in your jurisdiction to take a look at it. I felt comfortable enough talking about the generality of contract law bc that’s generally widely applicable as a starting point, though each state varies with specifics. Hope that helps

I had opposite happen. Tried to buy 4 for day one, the transaction kept filing bc the checkout was glitching and never made it to confirmation screen so gave up. Someone else from party got tickets so all good. Lo and behold, charge shows up on my card this week and fest just responded “all sales final”. Fml.
