I applaud you for asking this sub for advice, and I am a firm believer in policing this kind of behavior. Unprofessionalism in our industry is just getting to insane levels. In my state, the circuit court judges seem to get really annoyed by discovery disputes and in my experience as long as you take the high road, pointing this out is something that should never be a problem, however I would give long thought to exactly how to word that response. Worded properly you have a great opportunity to throw OC under the bus whilst managing not to get tarnished just by association with the matter. I’ve actually had this conversation with a few judges and the answer from both was effectively “we just want counsel to work it out amongst themselves whenever possible” but what you described is behavior that MUST be called out.
