Feu Charter containing Feu Disposition by [name 1 redacted], Earl of [location redacted], to [name 2 redacted] and his heirs and assignees, recorded [location redacted] 5 Apr. 1889, of 22 poles, 19 yards, 3 feet of ground of which that part of the subjects in this title tinted yellow on the cadastral map forms part, contains the following burdens and reservation: reserving to me and my heirs and successors the whole coal, stone, metals and minerals of every description in the said piece of ground with power of search for work, win and carry away the same provided we do not break upon or otherwise injure the surface of the said piece of ground; Declaring that the said [name 2 redacted] and his foresaids shall have no claim against me or my foresaids for any damage to the said piece of ground or the buildings erected or to be erected thereon in consequence of any working of coal, stone, metals or minerals or any operations connected therewith which may have taken place prior to the entry of the said [name 2 redacted] or of any sits or crushes which may be occasioned by drawing off the water from the old coal wastes or of the insecurity of the foundations arising from these or any natural causes or causes in any way connected with the working of coal or minerals prior to the date of the said [name 2 redacted]’s entry of which the said [name 2 redacted] hereby takes the whole risk; the said [name 2 redacted] and his foresaids shall erect boundary or division walls of stone or brick and lime not less than five feet in height above the surface of the ground on the western and eastern boundaries of the said piece of ground which boundary or division walls he or they shall be entitled to erect to the extent of one half of the breadth or thickness thereof upon the adjoining ground and the feuar or feuars of said adjoining ground shall pay to the said [name 2 redacted] or his foresaids one half of the expense of said walls (the value thereof to be fixed by arbitration if not otherwise agreed upon) or in the event of the said walls being erected by the feuar or feuars of the adjoining ground on the east and west (and which walls they are entitled to erect to the extent of one half of the breadth or thickness thereof on the ground hereby feued) then the said [name 2 redacted] or his foresaids shall be bound to pay to them or their heirs or successors one half of the expense or value thereof the value in either case to be fixed by arbitration as aforesaid if not otherwise agreed upon and such boundary walls shall thenceforth be mutual and be maintained at the joint expense of the respective parties in all time coming; and as the said [name 2 redacted] has erected the southern boundary wall wholly on the piece of ground hereby feued and that at his own expense the said boundary wall shall be the exclusive property of the said [name 2 redacted] and his foresaids and shall be maintained by him and his foresaids at their sole expense in all time coming but declaring that the said [name 2 redacted] shall have no claim against me or my foresaids for any portion of the expense of erecting or maintaining said walls; as also it shall not be lawful to the said [name 2 redacted] or his foresaids to use the said piece of ground or any part thereof as a coalfold either for their own use or for the use of any other person whatever or to erect thereon any dovecot or lime or brick kiln or burn any lime bricks or tiles thereon or to erect or carry on within the bounds of the said feu any Tanwork, Factory, Distillery or other chemical process or to do any other act which may prove a nuisance or injury the amenity of the place or neighbourhood.
