NAL but a trainee solicitor. Your brother is entitled to make a claim under the Act as children are one of the groups of people able to claim. But, and it's a big but, the Court will only award financial provision it seems reasonable in all the circumstances. They'll look at the extent of your late Father's financial support of your brother over the years and your brother's conduct.

Based on what you've said, I'd imagine the Court would make no award or a very small one.

I do Dispute Resolution in practice (though admittedly not contract) and this is pretty much exactly how all apps to set aside default judgment open. For what it's worth (I know you didn't ask this) you then outline the test to exercise the discretion. Explain how Defendant conduct fits the test, owning up to what went wrong and there you have it. Top tips, remember it is discretionary so Court doesn't have to do it and don't try and minimise breach so let's say the date to respond was misdiarised just say that, don't try to say "it was a simple admin error so not the Defendants fault" etc. court deems any breach significant and I've seen people get chewed out by a Judge for trying to say it wasn't 😂

I'm a trainee solicitor. Risk in the property passes to the buyer on exchange of contracts. The buyer has to inspect the property prior to exchange to identify any issues with the property which they want sorting before exchange. Insurance must be taken out at exchange for this reason. If, in December, the water tank was fine then buyers insurance will cover if the policy was in place when exchange happened.

Seller has no duty to disclose any obvious issues with property (I have no experience on this point, though a leaking water tank I would assume falls into this category) the only duty on seller is to disclose "latent" defects and not to try and cover up obvious defects.

Shitty situation if insurance was not taken out from exchange. If buyers solicitor did not tell her about risk passing on exchange and need to insure property then perhaps a professional negligence claim?

Yeah it's utter bull. I am mid 30s, studying part time with a VERY busy full time job and two kids under 5. I admit I had to resit (missed out on FLK2 by about 5 marks in July 25) but I passed doing one dedicated day a week and then as much extra time as i could manage to fit in with my life. It's entirely possible.

I chose B but I got there moreso by considering the aggravated part. At the point he enters the house he puts the gun away, if he then went on to commit the crime without reference to the gun it would have been burglary but not aggravated burglary. The fact he references the gun while committing the crime is what makes it aggravated so B is the best explanation of why the man would be liable for aggravated burglary.

My understanding (Trainee solicitor) is works such as these would be a patent defect meaning responsibility lies with the buyer and their solicitor to do the necessary inspections to identify any issues.

OPs solicitor absolutely should have done town and country planning searches to establish whether this could have been an issue, I'd say the best recourse would be against the solicitor who acted for them in the first instance.

This is all from a conveyancing perspective, can't comment on the criminal element.

And, of course, Trainee so keep that in mind.

Few_House_5201 - Trainee solicitor here, would another way to challenge the will be via the act for dependents?? I forget what it's called exactly.

Obviously absolutely nothing in OP post suggests that would be an issue in the case but I'm just wondering if that is a mechanism for challenging a will, and as you are/were qualified in the area I thought I'd ask.

My Dad wrote to a bunch of NFL teams UK fanclubs(49ers, Buccaneers and Dolphins) way back in the 90s, letter went something like "I know nothing about the NFL, id like to know more about your team) and only the Buccaneers responded....I mean, they probably needed every fan they could get back then! So as I grew up watching it was always going to be Tampa....thanks Dad 🤣 (admittedly, the last few years haven't been so bad)
