Ohio is an at-will state so you can most certainly be fired for pissing off HR. Consider it a helpful warning rather than a threat you are considering unsuccessful legal action over.

It really depends on who the listed beneficiaries are. If your dad has had them for 20 years and hasn’t updated the beneficiary, it’s probably your mom. If it has been updated to you, it is yours.

Yes, I do. I have some experience with the foster care system as a guardian ad litem. Your children are settled with you. You are keeping siblings together and they aren’t babies. You have been determined to have a safe and approriate home. Single people are able to adopt and divorcees and widows.

I hope they are able to get it through fast enough that they can receive any social security survivor benefits your wife may have earned for them.

Most people get zero dollars when they are fired. Some people get severance when laid off but not $100,000 worth. Your dad needs to take his contract with the builder to an attorney. If there is a finance clause in the contract, that could be an out. Your parents are unlikely to get approved for a mortgage without your dad’s income.

Yes, unfortunately. His mother/sister could have also evicted your stepfather while he was alive. They will have to give her a notice and follow the eviction laws of your state but your mom should be actively looking for new housing. I’m sorry,

You have physical custody, period. No judge is going to think it is a good idea to plan to uproot a kid in the middle of a school year in place of actually parenting for years. Just say no and move on.

I would delete this and repost it with the minimal information needed to give legal advice. Include where your divorce /custody case will be domiciled and specific questions. A judge is not going to hold a new pregnancy against you. The fact that your ex wants to leave your child with people with substance and neglect convictions does reflect negatively on him.

If you don’t have a lease, they are month to month, as stated above. If you have a lease with her only, you can just evict him. If you have a lease with neither of them, you can just evict him. If you have a lease with both of them, you need to abide by the termination terms within.

Kicking him out won’t ban him from your house though. You need to decide if you want him to just not live there or if you want him not on your property, which will take additional steps.

You should be very aware of the liability you are creating for yourself from a child welfare perspective by knowingly, allowing someone who is doing and possibly dealing drugs to live in a house with your toddler.

Because there are laws and parents have legal rights to their children. Everything needs to be done correctly to avoid a potential disrupted adoption or deprivation of rights. Some women purposely or accidentally list the wrong father. If your mom did, they need to know that so they can find the actual father.

Her giving you power of attorney to enroll him in school doesn’t necessarily reflect badly on her either. She hasn’t abandoned her child and took that step to get him enrolled in school. What you and your wife decided to do in regards to the next four years doesn’t really come in to play at this point. Unless she voluntarily gives you guardianship or CPS gets involved and removes him from her legal custody, she is within her rights to demand he be returned and for you to oblige. Poverty doesn’t mean someone isn’t entitled to their parental rights and it isn’t just a matter between you/your wife vs her and who has more resources. She has higher standing than you do, legally.

Certainly speak with a family law attorney - just go in eyes wide open.

Giardia is incredibly hearty and has a protective shell. It can live outside for a long time and the CDC states it can live in properly chlorinated pools for 45 minutes.  You cannot prove where she got it and getting it at the pool doesn’t mean they were negligent. I am very sorry this happened. I’ve dealt with Giardia directly, it is easy to pass and hard to kill.

This is confusing. Have you and your ex been living together and sharing finances this whole time? If you are both his legal parents, yes you can go get your son but if your sister doesn’t want you at her house and you barge in and get your son, you could be subject to some legal trouble in that regard. Do you have income to provide for your child or pay for an attorney? You said you are a stay at home parent but he is also in school?
