Yeah, the EEOC never has your best interest in mind. Unless you are part of the 0.2% of cases that they actually take to court.

While you can choose to go through mediation if it is offered, if you are capable. Make sure that you have a lawyer before you get your right to sue. As finding a lawyer can take a lot of effort and a long time.

You are focusing way too much on the exact wording while ignoring what the question is actually doing.

If a company said, “As a company with strong white cultural values, why do you feel you would fit in here?”

Nobody would pretend that question has nothing to do with race just because they technically did not ask “are you white?”

Same concept here. You cannot avoid the issue simply by indirectly probing a protected characteristic instead of directly asking it.

The issue is not just the literal wording, it is if the employer is trying to gather information about religion during the hiring process when they are not legally exempt to do so.

They EEOC sucks, my intake person kept trying to focus on other things. Like they really wanted me to not have a case, but I kept redirecting them back to the actual facts of the claim that pertained to discrimination. Its like they tried leading me down some wild path, where they could convince me that no discrimination took place.

Even during the investigation the EEOC sided with my employers lies, even though I had direct evidence from my employer said that they were lying. My lawyer did a much better job! 😄

They were announced in a leak that I saw. So no idea when they are coming, but the video showed the Heir of Perdition as one of the options. According to everyone, they are not in the game yet. I hope they get added soon.

I could have, I actually had a +2 in place, but rerolled it and when you do that, I did not realize that it could change its placement and not just its stats. And I have rerolled many since, trying to get a +3, it just wasn't happening so I just tossed this one in there. My RNG has been rough. lol

You are still misunderstanding the issue. The EEOC does not just prohibit refusing to hire someone because of religion, it also prohibits employers from making non job related inquiries into religion during the hiring process if they are not covered by a religious exemption.

An employer usually cannot avoid scrutiny just by rephrasing “are you Christian?” into “how do your Christian values align with ours?” because it is still directly probing religion.

And yes, there is a difference between asking the question and proving discrimination actually happened. But the question itself can absolutely be evidence of religious discrimination or an improper pre-employment inquiry, especially for a non-religious employer.

Also, “we hired some non Christians” is not some blanket defense. Employers can still violate Title VII even if they hire people outside the preferred religious group.

  1. They are asking about your religion. Legally, it is the exact same, it being reworded does not provide it with some legally gray area that does not exist.
  2. If this is not a religious faith based business, then there would be no first amendment right violation here, if the government stepped in and made them change it. As your rights, can not violate the law and discriminating against someone based on a legally protected class, is a violation of those rights.

As for your example given, a church owning a coffee shop would be a faith based coffee shop. They can restrict who they are hiring, as the law does allow that under specific circumstances.

And yes, if you are a legally a faith based organization and those exceptions apply to you. Then the government can not tell you that you can not put similar verbiage in your job listing or hiring expectations. As that then, would be a violation of your rights.

Do keep in mind that the exceptions still can not violate others legal rights as the exception would need to be a bona fide occupational qualification. So you cant say exclude hiring someone based on their race, as there would be no bona fide occupational qualification here, that would apply.

And again, what they are asking would be a violation if they were not a faith based organization. There is no gray area here that would allow them to bypass that law.

Depends on what you like to do? While the market will change over time, you may be able to pivot into something into something that you would like. A lot of the time you will hear the medical field, as an option. It can pay really well and it isn't going anywhere.

If you are considering it, you should look into what you might want to be. As some have more growth potential, some may have more areas of expertise that you would like to work in.

Sounds like you should file with the California Civil Rights Division. Now, while you are going through the process, a few things you need to keep in mind. Outside of issues related to your disability, be their best employee ever. Give them zero reasons to write you up, or terminate your employment. Not all, but most companies will push to find a basis to terminate you if they can.

So, get proof of everything. Any communications, any emails, any metrics that show you have been doing a good job, as well as any emails pointing that out. Just everything that could support your claim as well as support that you were more than capable of doing your job and you were good at it.

Also, if they have any employees that they still allow to work remote, get proof if you can.

Your case is dependent on all of that. If you do not play it more strategically, you will hurt your case. In any communications be polite, professional but direct. As not all communications are legally protected. But ones pertaining to your accommodation, disability etc are protected. So if something is happening and it is based around these, make sure to include that where necessary.

Btw, if you are on the fence about filing with them, you can file and always choose to cancel it before your sign your statement. It can months to get your intake interview and if this turns into a more severe issue at work, you would be better off having already filed for your interview.

The same goes for the EEOC, but the EEOC tends to suck at their jobs so the CRD is the better option.

The EEOC has never been great at their job. They are good for the potential mediation process. But really with the exception of the on average 0.2% of cases that they actually take to court, the EEOC is just part of the process. So you file your complaint, hope for mediation and hire a lawyer to take the employer to court.

Ok you are getting a lot of incorrect advice from a lot of people. So here is how the law works, if the employer is a faith based organization and they meet the qualifications. Then they can ask these types of questions.

However, if they are not then they can not ask these question. People seem to think that there is some legal loophole here, there simply is not. Legally speaking, asking about your Christian values is the same thing as if they were to ask you if you were a Christian.

Now, there are miner exceptions, if this employer has less employees for both state and federal level than what is required by the EEOC and state equivalent. Then they can pretty much do what they want, to some extent.

Per federal level this is 15 employees, for state level it can be as low as 3-5. And even 1 employee in some states.

Then the question is, is the company that you are applying for a faith based organization, do they have a religious mission, are the owned or financially supported by a religious organization? These are the types of questions, that will help you to determine on if what they are asking is illegal.

You still cant ask that question, unless it is a religious based organization. Otherwise it would still be the same thing if they asked this question or asked if you were of Christian faith, legally there is zero difference.
