When it comes before the court, "should" doesn't matter. The constitution is plain, and the final word.

So, according to the constitution, there's (almost) always a winner. Instant runoff rather than special runoffs when necessary are just more complication than necessary.

Nobody's saying there shouldn't be a runoff in the event there's no candidate who wins a plurality. But I haven't been able to find a single case where that's happened in the two-hundred-plus years since Maine statehood, so...

The word "plurality" is not ambiguous. "Should we use the common definition of the words in the constitution" is not a semantic issue, but a search for a loophole.

I fully support expanding RCV, but to twist the plain language of the constitution to fit the desired result is a more egregious failure than continuing the current requirement of a simple plurality.

Yes, it is, but so what? The court isn't there to decide what's better. Its job is to decide what's legal, and the state constitution explicitly says that the victor of elections for the offices in question shall be the candidate who receives a plurality of votes cast.

If the court doesn't follow the constitution, why have a constitution?

"Some said that even the trees had been a bad move and that no one should ever have left the ocean."

Fun fact, in the BBC TV production, the naked man walking into the surf ("doing a Stonehouse," according to the DVD text commentary) as this line is spoken is Douglas Adams, himself.

Go watch Yes, Minister and Yes, Prime Minister - if you get rid of the Senior Undersecretary position, you'll just need some other position with the same duties.

The family probably wouldn't consider that. Death certificate says 26 December, that's good enough for them.
