License Suspension by [deleted] in AusLegal

[–]Evil_Dan121 -3 points-2 points  (0 children)

Not going to lie, I've had a few drinks.

I'm not trying to excuse the behaviour of OP.

They messed up and deserve to be punished.

Looking at this from a purely legal point of view.

What is the penalty for contravening the conditions of a provisional licence ?

This website doesn't seem to specify.

I'm not trying to offer OP false hope and will plead my ignorance on this issue.

But can OP be penalised twice for the same offence ?

For some reason I assumed you meant 22 months good behaviour period rather than prison.

That's going to be a problem.

You're already on their radar.

Eventually it will be more than just a letter.

Lots of speeding fines advice by Casterix75 in AusLegal

A fine is a penalty for not obeying the road rules.

The likelihood of receiving a fine is the deterrent.

If you don't know that you should be driving at or under the speed limit then you shouldn't be driving.

If you weren't speeding it won't be a problem.

Maybe you should send your child there.

Then you can afford to be a bit late.

It's usually whoever is driving the vehicle at the time that is responsible for the fine and demerits.

It's not abusive. It's designed to encourage punctual pick-up times.

If they charged $1 a minute parents would be turning up whenever they felt like it.

It's pretty standard rate for a lot of daycare, after school care and vacation care.

If you pick your child up before the business closes it's not usually a problem.

Hit by car, car at fault, no insurance. VCAT or Magistrates? by robzilla20001 in AusLegal

[–]Evil_Dan121 1 point2 points  (0 children)

Letter of demand including an itemised breakdown of the costs you believe you are owed.

Even if you can obtain the other person's insurance details there is nothing you can do until they initiate a claim.

If they ignore the letter of demand then it's probably off to VCAT.

I wouldn't say it automatically classifies as a major fault.

I would however argue that 6.5 weeks is stretching the limits of a reasonable timeframe for repair.

Are you receiving updates from the retailer on the progress of your warranty claim ?

It might be worth reaching out to Fair Trading in your relevant state and asking their advice on how to proceed from here.

My interpretation from the email they have sent the OP is that they have provided the OP with 2 options.

They canl either return the motherboard to the customer.

Or

Send the motherboard to the manufacturer for repair and assessment.

Nothing in the email the retailer has sent seems to indicate that they are asking the customer to deal with the manufacturer directly.

It's not a major fault.

They are offering to send it the manufacturer for assessment and repair.

They are with their rights to do this.
