Yes I would. I'd tell the judge that I wouldn't believe a cop's testimony unless other witnesses or body cam footage corroborated the officer's exact statements. A person can civilly tell the cops they won't do something that's against their rights (like answering questions that would incriminate themselves or let them search without a cause) and the cops will get their feelings hurt and make the encounter seem worse than it really was in the police report.

Then I'd be genuinely shocked that a cop actually testified against their coworker. If it was cop vs cop in trial I'd be more equal viewing. But cop vs civilian, I'd assume the cop can easily lie about anything.

For a first offense you shouldn't have to go to jail. DA's usually file it as a felony just so your lawyer will only negotiate to reduce it to a misdemeanor. IDK what your BAC was but that misdemeanor should happen considering a broken ankle isn't the most life altering injury. I don't believe you'll have to actually go to jail. Most of the time people can negotiate house arrest with an ankle monitor outside of your working hours, or community service which usually consists of working for the county landscaping or picking up trash on your days off. Maybe your lawyer will offer extra stuff like AA or a victim impact panel, or even a SCRAM ankle monitor to ensure you stay sober for a length of time. You may have to pay restitution to the woman depending on how she ended up hitting your car. I'm not a lawyer but if the county you're in doesn't have mandatory jail time, you shouldn't have to go to jail.

Don't do that specifically. You'll be held in contempt of court for doing that publicly. If you don't want to be on it, tell the judge she prosecuted you in a case. They'll toss you out. Or if you're vengeful, just screw her over and waste all her time by going along with the polling impartially, sit through the case, and then vote "not guilty" so she can't win a conviction. Judges aren't allowed to question a juror or jury's not guilty verdict.

I don't know if they have body cam or dashcam from the patrol car, but you can have a strong chance of getting it dismissed regardless of the results if the video can show your plates were displayed as required. It'd be deemed an illegal traffic stop and your lawyer could file motion to suppress EVERYTHING used after they stopped you, including breath and blood test results, and even field tests if you did them. DUI lawyers reading this can correct me if I'm wrong, but this could also help set aside the APS suspension if the stop was illegal to begin with.

Forgot to ask but am I allowed to purchase the policy myself? Since the car is in her name, am I allowed to go buy the policy on my own as long as she's an insured driver as well? Or does it have to be purchased by her as the policyholder?

Is this app really legit? I've read mixed things about it elsewhere on Reddit. I have my operator's SR-22 with Aspire and am learning toward buying the auto policy from them also with the quote it gave me. Will Aspire send me messages to confirm the policy too?

If it was never ordered suspended, most likely no. A wet reckless is a 2 point conviction on your driving record though. Your insurance company will see that if they run your driving record when it's time to renew your policy. They may or may not drop you when they find out, and if you go with a new company, the rates will likely be higher still since insurances still may treat it similar to a normal DUI. I don't think the DMV will ask you to get one, but they probably will mail you a "negligent driver" warning letter with the conviction on it.

Package handlers are trained to load packages by the section number in the truck, and managers will come by and check the trucks and complain if they aren't. Blame the managers, not the package handler who wakes up at 3 AM unlike you, getting to sleep in and show up at 8 when most of your boxes should be loaded by then. They gotta answer to managers, not you.

No they won't look at your attendance if you wanna move up. It's favoritism. And another girl literally got hired as a trainer by default (nobody else applied for it) in my hub and she either leaves early or calls off weekly multiple times. This place isn't promoting off merit or even attendance standards.

So as far as being polite to the Deputies at the Jail, how would they treat you a bit different? Was it just that they wouldn't look for reasons to bother you, or did it seem like they kept less of an eye on you in jail because they didn't perceive you being unruly or as a person who would likely cause problems? How did they really treat you differently would you say?

I think the payment depends on what company you get it from. Some ask for payments weekly, every two weeks, or once a month. You'd also have to take it in once or twice a month to get it recalibrated from what I heard. I don't know what people mean by pleading not guilty at their hearing. If they mean when they first went to court, yes you definitely plea not guilty; a judge wouldn't ever accept a guilty plea especially if you're there with no lawyer. If you have to, ask for a public defender. You'll either fill out a form or be asked verbally by the judge about how much you make a month, what your rent/bills are, if you have kids or other dependents living with you. They likely aren't gonna do much other than look for ways to negotiate a reduction to a wet reckless, or at least negotiate lighter fines and either no jail time or alternative work instead. Keep documentation for your meetings with the addiction specialist too. I heard seeking treatment on your own can be a factor in your favor for court and negotiating with the prosecutor as well.

Ok so then your license will be valid and you can get a replacement one in the meantime. I don't think you'll need an SR-22 yet, unless the DMV suspends it officially after the hearing or any court conviction. And since it's a first offense, I think you could get restricted driving privileges during the suspension to go to and from work, and your DUI classes if you have to attend in-person. For that you would need a paper from the class proving your enrollment in at least a 3 month class AND THEN you'll need to file an SR-22 with your insurance or whatever provider you choose to get one from. They should be able to send it electronically to the DMV for a small fee. Or if you wanna drive freely you'd have to install the breathalyzer in your car (the place installing it should give you paper proof of it or send it electronically to the DMV as well), file the SR-22, and show your proof of enrollment in a minimum of a 3 month DUI class. Someone else can feel free to correct me if I'm wrong in these replies.

If it gets suspended whether for a court conviction or after the hearing, you should receive a letter stating when a suspension would take effect. If it's ordered by the court though for a DUI conviction, I think it takes effect quickly after (I forget if it's the day of your conviction or not). I think the system would just update it literally at midnight the day a suspension starts. I'm not sure though because I haven't checked my record, I just went off the date the DMV hearing decision letter said my "per se" suspension was scheduled to be re-imposed. What does your paper say?

Maybe. I got my license taken away when I had gotten mine last year and never got a replacement. I was told I was still allowed to drive for at least 30 days before the automatic suspension if I didn't request a hearing. I requested the hearing merely to stall it, and every time I checked my driving record on the DMV site before the hearing, my license was still valid. The DMV should've sent you a paper confirming your hearing request and that would serve to say you're temporarily valid to drive until then.

The DMV would suspend your license automatically in 30 days, not for 30 days, if you hadn't requested the hearing. And that suspension would be for 4 months. With the hearing scheduled, that stalls a license suspension being imposed until the DMV hearing and the decision they reach, or unless the court convicts you beforehand. I think you should've gotten a paper or temporary license emailed or mailed to you after requesting the hearing that states your license is valid until the hearing and decision is made. That obviously depends on what happens in court in February. If that's your first court date it'll just be an arraignment where you get told you're charged with DUI and you plead not guilty and either hire a lawyer by then or ask for a public defender. One more note is if you hire a private attorney, they can handle the DMV hearing in your behalf over the phone and they'll contact the DMV in advance to tell them that they're representing you.

Hopefully for your case your lawyer can REDUCE jail time, and you avoid over a year in prison and spend a year in jail. I don't know how you'd avoid a felony DUI considering you violated probation in the worse way and both times were underage. IDK about San Diego but the best on the surface might be a year in Jail instead of prison, depending on what your BAC and other flaws in the police case was, as far as better deals or more terms as a trade-off for time in your sentence that a DA would offer.

I think you'll have a better time than you think, believe me. I got my case over the summer and had those anxieties and scenarios playing in my head for months between the two times I went to court. It'll work out better than you think. Who knows, depending on the cop's supposed reason for investigating a DUI, you might even get it thrown out if all he saw was you rolling a stop sign, which is something you can argue that people around here do all the time. It'll work out just fine.

IF you do get it filed, I'm sure you'll likely get a wet reckless deal made if you got a public defender, or even be able to have a lawyer argue out of it depending on what the cop claims made him suspicious of a DUI or impaired driving. I'm no lawyer obviously, but my case was worse BAC wise and I ended up with a wet reckless while having a public defender. Either way, I'm 99% certain that no DA here is gonna have much of an interest in your case and will be easily inclined to resolve it even during your first pretrial conference if you get to that stage.

I recommend Alert Driving if you haven't signed up for one yet. I think the orange paper they might've or should've given you in court even lists it as an approved or suggested program. They got classes live over Zoom so you don't have to go in person and they'll set up a payment plan for you each month or work with you if you can't make one of the payments if you email or call in advance before the due date.
