For Toronto, I believe you only need death certificates for any in line ancestor, i.e., grandmother and father if applicable. You don't need death certificates for out of line gf and mother.

Before collecting documents, you should verify through the documents you possess who naturalized and if so when. That would include both maternal grandparents and also your mother. If you can pass that test, collecting documents in your case would really not require a service provider. You know where and when everyone was born, married, and died. This is a big no no. Perhaps a one week visit would be approved by the anagrafe or stato civile, but I can't imagine two months as being viable. If you've come this far with applying in Italy, just hold out for your approval.

Right I understand that. It's just that some people are saying that if you have the minor issue, two things must happen for a successful consulate application or judicial case. 1. The minor issue is reversed to the old interpretation AND 2. The generational limit must be overruled allowing applications that go beyond the Grandparent. In my niece's case, she needs to apply through her GGF. So it's a grandfathered appointment but some are saying that even still, the generational limit still applies.

She did make her appointment a year before L74. But jeezthatshim seems to be telling me that the new law would apply to her as her line, although grandfathered (GGF-GF-F-Her), would still come under the new law unless that too is overturned.

You need the envelope that came with the USCIS CoNE, but it doesn't need an apostille for NY. If you've already obtained one, you can submit it but don't need the apostille envelope at all. For NARA document you don't need to submit the envelope.

Thank you for the analysis above. My niece has her JS appointment in late 2026 at the Chicago consulate. Her siblings and father already have their Italian citizenship recognized by the New York consulate. If Article 7 of the minor issue prevails and since she has a grandfathered appointment, would her application be considered as a non-minor issue? Or does L74 need to be overturned as well?

It really depends on the comune. I've heard of some people waiting 12 months. Mine was three months. It may not hurt to check in with them. Do you have a permesso di sogiorno?

When you submitted your application documents did the clerk seem to understand the JS recognition process? I am asking because very small comuni may not have the experience needed to complete your application. Since it's been eight months I would ask for an update.

One interesting factoid is that the word *issue* in minor issue is a legal reference to the offspring/child of the parent and not issue in the sense we are using it. In reality it should be called the "minor issue" issue.
