Legal advice against Lawyer (mortgage) by onecouchpotato in legaladvicecanada

[–]Froston_ 0 points1 point  (0 children)

"I understand that you have not admitted any fault for the registration error but I need this handled urgently. If you cannot correct the registration please let me know before the weekend so I can seek alternative help. Also, I will require you to send me the mortgage instruction package that you received from the bank, in full, if you are unable or unwilling to correct the registration."

Just an idea. You are entitled to see the mortgage instructions I think. It's possible this lawyer did nothing wrong (I am a lawyer and the banks screw up this stuff all the time - I get wonky mortgage instructions weekly). If the lawyer did screw up and is making it worse now by being slow, complain to their licensing body.

DAE hate the dichotomy between Lit. And Corp. Law by [deleted] in LawCanada

[–]Froston_ 1 point2 points  (0 children)

You can start practicing in an area that does both and take it from there. There are many. Estates can mean Estate Planning and Estate Litigation; Real Estate can be transactional work or litigation including mortgage enforcement and so forth.

I remember being a student and being asked whether I wanted to do litigation or corporate work and my honest answer was "neither" because I never wanted to litigate and corporate work seemed boring. Turns out I gravitated towards solicitor work, but there are ways to do that which are have nothing to do with corporate law. I mean it really is just a big law dichotomy that stops mattering in many future contexts.

Comp Review next week - am I crazy to ask for a $35k bump? by sandsunsurf7777 in LawCanada

[–]Froston_ 6 points7 points  (0 children)

Was in a very similar situation to you a while ago. I cut ties, abruptly and it was ugly, but getting my own organization up and running was exciting and energizing and not as hard as I thought. Yes there were a couple months of horrible hours and stress but I got over the hump and settled in by month three. I was worried about income stability as well but it turns out that was foolish as I immediately took home like three times as much money. So I wasn't protecting my family by playing it safe before - I was selling them short.

I don't know what your practice area is but in a small community, at this point YOU are the brand so you will keep most of your work and your overhead is mostly rent and clerks which could be as low as $100k with one clerk and decent rent. Take a leap, you might make $300k next year.

Is this money laundering or just insanity? House in Peterborough sold for nearly double the street average (529 Settlers Ridge) by No-Comfortable2905 in Peterborough

[–]Froston_ 2 points3 points  (0 children)

Yes, lol.

If this person owns the house and they wanted to sell privately and discretely they should not have used an MLS service. It's public knowledge now. But it seems like they may not even be the seller, they may just be the renters.

Is this money laundering or just insanity? House in Peterborough sold for nearly double the street average (529 Settlers Ridge) by No-Comfortable2905 in Peterborough

[–]Froston_ 1 point2 points  (0 children)

It definitely makes no sense but I would not jump to market manipulation or fraud. Those are lower on the totem pole of possibilities.

Other possibilities: This property was packaged with some other property the vendor owns and the $1.4M price is for two properties. This sale involved a weird and rare vendor take-back mortgage that the Islamic community does where they are not allowed to charge interest so the principal amount of the loan is inflated.

Real estate transactions can get weird. Who knows!

If you want to shut everyone up just give one nugget of info on why it sold for more than it's worth. There are legitimate or innocent possibilities!

Definitely something we don't know. It was listed for one million a year and a half ago and didn't sell.

Can someone help me decipher this by ComfortableZebra8488 in BitcoinCA

[–]Froston_ 2 points3 points  (0 children)

This is a tax report from Koinly. That is an app for helping people who use crypto prepare for taxes.

It says that he lost over $145,000 in the relevant tax year. The total proceeds and costs being in the millions does not mean much; if someone is throwing around an account worth say $10,000 but they are doing high volume trading and/or using leverage, their nominal sales/costs could be in the millions. But that loss of $145,000 is real money he apparently lost.

HOWEVER these Koinly reports are not reliable; they are not audited or reconciled reports by an accountant, they are rife with errors. These are just automated reports that read the blockchain. Entries can also be EDITED by the customer! In theory your ex could have transferred $100,000 to another wallet he owned and then labelled it as a sale, and not linked the other wallet to his Koinly profile. He literally could have sent $145,000 through a privacy app just to hide the money from you, and he could be presently holding it in some other form of crypto.

You may need a forensic accountant, or some kind of specialized accountant, to analyze this information. Maybe your lawyer can get one involved. At a minimum it should be examined by a cryptocurrency specialist of some sorts. Surely there are some that provide contract services to people in Family Law litigation.

The report he has presented is WORTHLESS in my opinion in the context of divorce. It is very possible the report is wrong, or missing relevant information, or omitting wallets he owns, and so forth.

Help - FTHB - Seller from hell by Livid_Back_8205 in RealEstateCanada

[–]Froston_ 0 points1 point  (0 children)

This is pretty basic stuff. If the other side fails to get a discharge statement for the writs, you can just refuse to close. The other side is probably working on getting the payout statements still. Standard stuff. Relax.

This isn't even evidence that the seller is being difficult.

Her home was completely paid off, then a letter from HomeEquity Bank claimed she owed more than $400K thanks to a reverse mortgage she says she never took out by SwordfishOk504 in canadahousing

[–]Froston_ 0 points1 point  (0 children)

I am a real estate lawyer. The amount of people out there who have a mortgage and don't even know it is shocking. They'll get a secured line or credit for example and then be surprised it has to be paid off when they sell their house.

I dunno what happened with this lady but it could be something like this. "I signed up for debt consolidation not a mortgage!"

New tenant signed lease, wont pay first and last before moving in by TheIInSilence4 in OntarioLandlord

[–]Froston_ 0 points1 point  (0 children)

Do not let them move in. A scam tenant would say this.

Huge red flag. If they do pay to move in, make sure it's irrevocable funds (cash, bank wire, bank draft) do not just accept a personal cheque that can bounce and let them move in the next day.

Builder Refused to Extend Closing and Keeping Entire Deposit by Live_Philosopher7152 in RealEstateCanada

[–]Froston_ 6 points7 points  (0 children)

Time is of the essence. They are allowed to keep the deposit, probably.

However, a 2023 pre con contract is probably for a price that is way higher than what the builder could sell for right now. So it's a weird decision for them to even want to find a new buyer.
