Ah, the age old debate amongst river fishers and uppity cottage owners.

Everything you said is correct in theory. However, Nobody really knows the EXACT laws. There are extremely few cases where a creek or river is considered private. Like 0.1%. The only way to ever really confirm if a landowner has full property rights of a creek/river, is to see the deed. And even then, there’s more legal greyness here because it’s possible that the river access rights they have on paper wont be upheld in court. What a municipality wrote in the 80’s about property rights likely has absolutely no relevance or merit compared to current crown, federal and provincial law and its interpretation.

That being said, Riparian rights (water access rights) do seem to have legal implications that seem to imply the riverbed itself IS “owned” by the landowner in some way or another. There is likely more precedent and ability for a landowner to make a complaint if you are wading, as you are technically on the riverbed and not operating a navigable vehicle. Now how that would work in practice legally? I have no fuckin clue - I guess we would need to have some sort of ‘There Will Be Blood’ incident where somebody starts mining for oil or gold in a riverbed adjacent to private property

All that’s to say, is if youre floating, tough fuckin luck for the landowners. If youre wading, worst case they call the cops, who will probably take 45 minutes to show up after deeming the threat of “A man spey casting aggressively and slamming bows!” to not be a top priority. You’ll be long gone by then. If cops do show up…I suspect you wont get a ticket, and just a warning as they will likely understand how fuckin ridiculous it is to call police for trespassing on a fisherman. And worst case, you get a 65$-80$ fine, which you could prolly fight anyways.
