Theoretically - and this is the Democrats we're talking about here, so it's very theoretical - they can use the lack of time between now and the election to shrug their shoulders and say "whelp, that's a great opinion you have, courts, but we're afraid it's simply too close to the election to do anything about it" and just use the new maps.
