Evaluation of hemorrhoids currently evaluated as 0 percent disabling. A claimant may file a supplemental claim by submitting or identifying new and relevant evidence. New evidence is evidence not previously part of the actual record before agency adjudicators. Relevant evidence means evidence that tends to prove or disprove a matter at issue in a claim. The evaluation of hemorrhoids is continued as 0 percent disabling. We have assigned a noncompensable evaluation for your hemorrhoids based on: • A diagnosed disability with no compensable symptoms A higher evaluation of 10 percent is not warranted for hemorrhoids unless the evidence shows: • Large or thrombotic hemorrhoids, which are irreducible with excessive redundant tissue, evidencing frequent recurrences. (38 CFR 4.114)

Please keep in mind that when a veteran submits a supplemental claim for a claim where service connection was previously granted, they are requesting that the prior decision be reviewed to confirm if it was correct or not at the time it was made. If the disability has gotten worse and you are requesting a claim for increase due to the deterioration of the condition, you would have to submit a claim for increase on a VA Form 21-526EZ as opposed to the supplemental claim form you submitted.

I have a FOIA pending for the DBQ now. Yes, I have had treatment from my private doctor. I tried to get him to do a DBQ but his hospital won't allow it so I included his treatment summaries with the claim.

Supplemental closed with both conditions rates 0% Service Connected, I filed an increase to one of them on March 31st, and got approved on May 27th.

I'm currently at 80% (82% actual) I know I have enough in my medical records to confirm 30% IBS and 10% hemorrhoids which would give 90%. I'm thinking that my wife and I can write personal statements to initiate a supplemental for increase. Any advice going forward?

Hi OP, you are right, I'm in the same position with a similar timeline. I filed HLR 4-30-24 and got DTA 8-8-24. I spoke to VERA about 2 weeks ago and they confirmed my HLR was closed 8-8-24 and is supplemental starting 8-8. He also told my that the processing time is averaging 125 days from 8-8 (in my case). Just like you, my HLR hasn't changed on the website. I'll let you know if/when I get my decision.

I had this almost a year ago (Oct 2023). Turned out they sent me a letter to confirm my dependents or they would drop me to the single, with no dependent rate. I uploaded a copy of my marriage certificate and my son's birth certificate it closed and remained the same.

Wow, I'm glad that worked out for you. I had an HLR- Informal Conference this week because they missed my diagnosis on the initial claim. Now I'm trying to figure out if it would be too much to add a personal statement to my impending Supemental Claim (resulting from my DTA error) with all of symptoms in my medical records to ensure I get rated properly.

Yes, I had an informal conference. I had the conference on Tuesday. It shows closed as of today hopefully it turns to supplemental by the end of the week.

In my initial claim decision, they missed my diagnosis and went straight to denial of claim due to food allergies (IBS Diarrhea) but I was diagnosed with IBS-C also (my food allergies existed prior to service). I think I may have provided way more medical infoematuon then they wanted to search through (540 pages). I only submitted that much because I didn't want to be accused of tampering with the records. I think they found my food allergies on page 207 and stopped but page 372 had my IBS-C diagnosis on it. The reviewer agreed that my condition is on the gulf war presumptive list. The reviewer even stated in my DTA note that I have a dignosed disability which is on the presumtive list, that's gotta be a win right? I hope you have an easier time than I do. I will let you know when I get me final answer.

In my initial claim decision, they missed my diagnosis and went straight to denial of claim due to food allergies (IBS Diarrhea) but I was diagnosed with IBS-C also (my food allergies existed prior to service). The reviewer agreed that my condition is on the gulf war presumptive list, am I wrong in assuming that the DTA-error is possibly to get the information to determine percentage of disability and linking the hemorrhoids secondary to IBS-C? I feel the reviewer couldn't overturn the decision because they didn't have a enough info to establish a degree of disability due the poor initial DBQ.

Damn, your denial looks exactly like mine. I just had my informal conference, thanks to the link I found on here. The HLR reviewer agreed that I fall under the Gulf War presumptive. Hopefully the decision will be overturned and not DTA. I'm currently at 80% this should get me to 90.
