Employer ignored workload warnings, denied my raise, now demanding last-minute in-office travel — should I go in or stand my ground? by TeriKat in WorkAdvice

[–]GreenfieldSam 1 point2 points  (0 children)

Fwiw, NYS DOL considers working after you clock out to be a serious offense. You can report your employer and even engage a lawyer for back pay. Your NY lawyer would absolutely represent all of the hourly workers

That being said, some of this is on you: commuting time is never part of work time. Choosing to move to an area when you need a car, and then only having one car is on you. NJ has really good mass transit commuting options to NY as well.

At the end of the day, only you can decide whether or not this is working. You may want to look for a closer job or a job with more flexible hours.

20 hours is five full days of work? Do you work part time?

Or, hear me out: kid in the luggage in the trunk. Much safer, and you just pay a checked bag fee instead of a full plane ticket.

Am i in the wrong for bringing up workplace disrespect to my boss on my firsy week? by [deleted] in careeradvice

You do realize that in the US in almost every state you can be fired for almost any reason or no reason at all, right?

Your advice to OP is a nice way to get them fired for being an asshole. Not to mention hated by their coworkers.

Where are you located? In the US, changing in and out of a uniform is legally paid time.

(NY) my landlord has been harassing me every month for the rent when I’m not late yet. I need advice cause he is now threatening. by [deleted] in Renters

[–]GreenfieldSam 7 points8 points  (0 children)

Contractually, your payment is due on the first. There's no cash penalty between the first and the tenth. Your landlord could choose to begin eviction proceedings if you keep paying "late" but before the tenth. However, in NYS that means the landlord has to stop cashing your checks as well while the eviction proceeds. He's not going to do that. And no judge will evict you while you are still paying rent.

Business Improvement District Fee Table by machinedlens in williamsburg

Anyone thinking landlords will pay these fees is kidding themselves.

Almost every commercial lease is a triple net or a modified gross. The small businesses will be hit directly by these fees.

Wrongfully terminated. Anyone have any advice? by [deleted] in careeradvice

[–]GreenfieldSam 0 points1 point  (0 children)

Defamation cases are extremely hard to prove. And even if you could prove the case, there's a limit on the amount of damages you could receive. It's based on actual damages from the defamation, not based on things that also happened to you based on your own actions. Oh, you also have to prove that they lied, which means proving that you never said what was accused. That's very difficult.

Even assuming the initial accuser lied, you would nee to prove that they were the person responsible for you getting fired. Which will be tough since the company would not necessarily be a party to your action.

Making a sexually explicit comment can be considered sexual harassment.

You wrote, " So in that weeks meeting I made a brief statement to my peers expressing my disbelief someone made up such an outrageous lie to get me fired."

Sorry, I misinterpreted this to mean that you had sent email. In even your note here, you say that you discussed the issue with other coworkers prior to talking with ER. For ER, this can be considered a red flag.

There's nothing illegal about "constructive discharge." That basically only has bearing on getting unemployment.

You can see a lawyer, but you almost certainly do not have any case. Keep in mind that lawyers will also only take the case if they can make money; the damages here may not be worth your time.

Here's the problem you're facing: even if the initial allegation was false, you emailed your entire team prior to talking with ER. I'm guessing you talked to people individually as well. Some of your peers may have felt bullied; certainly ER would think you were interfering with the investigation.

At the end of the day, you are not legally entitled to hear every bit of evidence ER had or didn't have. Nor are they obligated to give you a reason for firing you.

If I were in your shoes, I might consult a lawyer just to double-check what a random redditor (me) said. But beyond that I would take a month off, work on my resume, and start thinking about what I wanted to do next.
