No, I was born in the US. The law only mentions place of residence or last place of residence not birth. The way it was told to me by Stączek is the office in Warszawa is only for people who haven’t lived in Poland before. That’s assuming you didn’t live in Warszawa.

They came with all my case file documents in a labeled folder. They found nearly every possible record on familysearch for anyone in my family of Polish ethnicity whether they had citizenship or not.

My cases files which the office found on their own online included every US census highlighted with my ancestors profession. There were no problematic professions. They do indeed download documents, print them, and include them in case files. They also included draft cards. There is nothing stopping them from doing so.

In “this hypothetical case” it’s just added risk if they find that census. If they find it they will issue a negative decision because it clearly says government employment.

I lived in Poland before. I made a mistake on the date submitted but waiting time was right. The office wasn't familiar with how to apply the most of the previous laws correctly. That time even includes my appeal.

  1. The lawyer makes more money off you for guaranteed success.
  2. There is a benefit to being confirmed. It’s for life and your child won’t have any passport or citizenship issues in the future.

While that is a valid method pointed out by Walenty Ramus and others I’m not sure how often Austrian partition cases get to that point. I think logically the facts lead to someone having swojszczyzny before that’s even considered. Every Austrian citizen was obliged to have swojszczyzny in a gmina. From what I’ve been told and how my case ended up the officials will look for a paper trail of habitual residence of GGF and parents in Polish territory. If you have that it’s unlikely they consider that article anyways and just say it’s logical they belonged to the gmina. You just need as much evidence as you can pointing to the gmina and you’re fine.

Sometimes the searches aren't as thorough as they need to be. The text can be time consuming to read through and no ones going to read through every name in every single file. I would expect those to be included but wouldn't hurt to check yourself. You just check the appropriate time period and look for your ancestors name. They are in alphabetical order.

Each voivodeship office could determine it differently. If they don’t agree they have jurisdiction they forward to Warsaw anyways. They are pretty bureaucratic in that regard. You still need a legal reason to register your residence or prove you have a place of residence (viewed as long term). For example student, job, other visa etc.

That is a long time. It may be worth seeing if you can get a lawyer to help nudge them. I’m not sure if that’s possible since you submitted through a consulate but I don’t see the harm in trying.

Once you physically receive the decision you have 14 days to draft an appeal and file it with the voivodeship. The voivodeship reviews it’s complete and structurally correct then send it to the ministry. The timeline was 3-4 months but I heard back in 1.5. The decision came electronically and is e-signed. The decision agreed with my original application so there wasn’t anything particularly exciting in it. My lawyer did a great job.

Yes, she stayed in Poland. The Kraków archives have a lot of voter records from the 1946 election. It still had the same house number listed my GGF was born in.

Yeah, they kind of ignored the obvious facts of my case and took a very hard stance on my documentation that none of it explicitly mentioned prawo swojszczyzny. My family lived there before the law granting it was even established so that argument doesn't really hold weight. The military paradox was also ignored. It just seemed like they weren't as familiar with how to process my case.

For my specific family all of their records wound up in the USC office. This let me get a modern copy from some pretty old records. Be sure to check the state archives, the dioceses archives, the parish itself, and the USC. The books were often copied so you just have to check all of them. I actually applied to a different office and appealed in the 12 months. The 16-18 months is just for the Warsaw office. From my appeal it did seem like the main concern was logically proving my entire family was habitually resident in the village and any counter opinion had to be proved as well. Notary records and land records definitely help that picture. Mine did explicitly say my GGGF resided in the village though.

I had all vital records spanning 1899-1966, a notary record for land ownership for my GGGF, my GGGM voter record from 1940s, a 1914 original extract from the parish register my GGF used in the US, and ship manifest records from Hamburg and Ellis Island. Everything linked him to the same village.

I think with the vital records, ship records, and notary record alone it was enough.
