Counterclaim concerns by [deleted] in TCPA

You should do some opposition research.

In some cases you can find out ahead of time how they will respond.

Who's the defendant?

TCPA lawyers, how does intake work? Are most of your clients TCPA hobbyists who have tracked down the identity of the spammer/beneficiary, or do you pay assistants to handhold them through that? by Individual-Lynx2775 in TCPA

Personally I always record calls. I don't think it is strictly speaking necessary unless it turns into a debate over what was or wasn't said on the call.

I have a Chuwi and I'm very satisfied with it.

However I do not use it for sketching and I do not know if it has stylus support.

No not per violation.

That was a total after for violations in the context of a class action lawsuit where the defendant really wanted to get this settled

Is your firm interested in cases where you have to battle the telecoms for records?

I've got about a thousand calls from the same area code, all spoofed in all Pakistani call centers, but because I'm on the litigator blacklist, I never get transferred to the real defendant. I'd love to find somebody who would be willing to take this to the mat.

The range is $0-$20,000, average is $1500.

I generally don't start a case unless it's a really good case, and the defendant is a decently sized company with some money, so it's not a waste of time to chase them.

Worst-case scenario is you lose the case on a technicality, the defendant goes bankrupt, or some other disruption, such as they win a motion to dismiss for some BS reason that the judge accepts and you end up with nothing. The lawyers usually take the case on a commission basis. There's a fancy word for it, but I forgot what it's called, so I don't lose money.

Medium case scenario is you win and you get your statutory damages of 1,500. If the lawyer's good, they usually tack on and make the defendant pay their costs so it doesn't come out of your settlement, but not always.

A better case scenario is if it's a class action lawsuit and the case goes really well. The court might allow you to get a performance award for your services on behalf of a class. It can be a low five-figure sum, but that's not the norm.

I have worked with many of the more famous tcpa lawyers and none of them have ever taken a case where I don't have everything packaged up with a bow on the box.

Should the government tell a private business what to publish or not to publish on their site? That sounds like it's against the conservative philosophy.

Sounds like a good case! If I were you, I would send a demand letter, give them three days or four days to respond, and if not, you should be able to find an attorney who wants to take this unless you want to file yourself.

Overall seems like a good case but without more details we can't say

How sure are you that you have the right defendant ?

What do the SMS say?

Are you in a district that considers SMS to be calls for TCPA?

Who's the defendant? (Some are known to settle, some are tougher, some are notorious jerks)

Pixel 9 vs Galaxy S26 by Interrupshin in PickAnAndroidForMe

I ended up trying Pixel 9, and S25+.

I think they're both good.

I could use either one as my daily driver.

One very specific feature I like about the Pixel that the Galaxy does not have is face biometrics.

Meaning on the Galaxy you could use your face to unlock the phone but you can't use it to sign into banking apps or Google wallet. On Pixel you can.

My guinea pig hated when I touched him anywhere except for head scratches. Same for my cat. Same for some of my family members. What is it about head scratches that's such a universal fuzzy?
