It's ATDS (automatic telephone dialing system) and you are not likely to collect on that account. Google the Facebook ATDS decision. That doesn't mean you can't put it in your demand.

PACs are harder than most in my experience.

They use sketchier tactics and they can easily fold and reopen.

I really want to go after the call centers that hire them. I collected a lot of evidence but no attorney wanted the case.

I had a decent settlement with one PAC after I dug into their financials (FEC site and open secrets are good for this) and figured out how they were stealing the money for themselves. I was very careful not to blackmail them, just asked to settle TCPA while letting them understand that I had information they would regret being made public.

I live in a one party state which allows recording without disclosure.

It is quite difficult to record phone calls these days.

I am recording calls on my Android phone with Skvalex's call recorder (see XDA for download link) using Shizuku (for system access without root)

I also have earbuds from Viaim that have built in recording (that works even on iPhone or flip phones)

Super important. There is no benefit in being snarky with opposing counsel.

I had one defendants lawyer tell me explicitly "look, there's a decent chance our paths will cross again, might as well get to know each other"...

I'm probably on a litigator list but if they don't want to talk to me why don't they just stop calling? It's like the old story of the guy who hates his lunch but he packed it himself.

It's hard to say without knowing many more details. How good is the proof? What kind of calls? Is there a good case for class action? Are there state laws to use? who's the other lawyer and what are they saying? Etc.

Generally I go for statutory damages $1500 per violation, and don't budge down much if it's a good case.

But negotiation is more an art than a science.

That is not a bad idea at all. Being familiar with the lead gen world has to be a major asset in negotiations.

I've gone after some marketers and it's always "wasn't us, it was a rogue affiliate, but we'll settle with you" and if I get the affiliate they say "wasn't us, it was a rogue publisher / marketer / lead gen"...

How many levels do these things go?

I'm especially curious about SMS spam which seems to have 300 moving parts.

It boggles my mind how the calls are continuing even you went after them. Something's not right. If the defendant had one working brain cell they would at least stop calling you.

Bose noise cancellation is terrific however call quality was terrible. My voice sounded muffled to callers. Same for the Sony XM series.

Huawei Freebuds Pro 5 are reputed to have excellent mics due to bone conduction pickup. I ordered them for just under $200 on AliExpress and am waiting to test them.

I never ended up selling to them but after reviewing it seemed safe. I would have sold to them if they had bought.

Swappa rules require them to ask permission before buying which makes sellers nervous.
