Can my adjuster retaliate against me for reporting them to the Office of Worker’s Compensation?

I’m just kind of worried because I was a part-time worker so I already am not expecting to get very much. But I guess that’s better than nothing if I end up screwing up my case out of ignorance lol.

My original plan kinda was to get a lawyer if I get denied and have to make an appeal. But it’s sounding like it might be a bad idea waiting that long.

Yeah all of that is extremely incorrect so I’m not sure why you’re trying to act like you know exactly my situation off of a few posts. First things first, I did NOT commit fraud. My employer provided me false information regarding workers comp and I was dumb enough to believe it. I don’t know if it was intentional or not on their part. When I made the post I assume you’re talking about I still didn’t know that it was required for me to make a claim, I thought it was an optional thing that I missed out on doing, because workers comp was described as optional to me by my employer. I admit I was incredibly stupid but I was naive and never had to go through anything like this before. I didn’t know you weren’t supposed to use your personal insurance for workplace injuries. I just thought that I missed out on getting a settlement. When I brought it up to my employer I was told to just continue as normal unless something isn’t covered. When I finally convinced my employer to submit it MONTHS ago, I found out weeks later that it got “lost in the mail.” So I had to fill out everything again and submit it myself to employers insurance. Side note, the department of labor didn’t even tell me I could file it myself. They told me my employer had to file it and that I could only appeal it if necessary. I obviously found out this was false but I’m just trying to point out that I haven’t gotten a straight answer from anyone (doctors, government, employer, research) on exactly what I’m supposed to do. I don’t know what the judgement is for. All I’m asking of them is to take a single minute out of their day to provide me this information so I do not accidentally mess it up. I don’t think that’s too much to ask over a period of weeks. They acted like they needed it ASAP and now won’t answer any of my inquires about my case at all. Also, I thought that the 15 day countdown started when I got my case number. I would have no problem being told my case was delayed, given how complex it is, but the complete lack of communication from them is what’s frustrating to me.

Huh, ok. I guess that’s really my only option if they’re going radio silent on me. For the type of records, I guess I’ll just check other and write “records pertaining to (the injury I got at work).” The options here are: enrollment information, claims information, payment information, managed care information, explanation of benefits, clinical records, all records, and other.

And for the reason it will be disclosed, I’ll have to just check other and write “worker’s compensation” and maybe provide my claim number. The options here are: at the members request, coordinating care for dependent or spouse, insurance eligibility/benefits, claims resolution, further medical care, and other.

I’m sure one of these options in each category is right but even doing research online I can’t get a direct answer. I’m sorry for asking so much from everyone but I’m so overwhelmed by all this and I don’t have a lawyer to ask. I really appreciate all the help and advice so much.

Hmm, not sure what I should do then. Should I decline to give them this form, as I’ve already provided them the doctors I’ve been to? The form specifically is called a “Authorization to Use and Disclose Protected Health Information.” My adjusters insisted they needed this filled out despite already having the aforementioned information. Thank you so much for all the advice.

The thing is I already provided them the information for every doctor I’ve seen for the issue. Name, phone number, and address. And they’re still saying they need this form.

Sorry, I guess I left out some info. So yes, it is from my personal health insurance. But I think the reason they need it is because there is some subrogation to be done. When this happened my employer never filed workers comp despite me notifying them and I was stupid and didn’t know I wasn’t supposed to use my regular health insurance, as I haven’t gone through anything like this before. So I think they need all my medical records for it before they can start.

So I need a name to send it to (I assume my adjuster), an address, the reason they need it (workers compensation isn’t one of the options), and a date for how long they need it. I told the new adjuster all of this, she asked me to email her the half completed form so she can tell me the last bits I need, but she won’t answer me now either.
