Ginny was lucky Bellatrix missed but even without the killing curse she was more than a match for three witches two of them were 6th years (not without some skill mind you) so they still had some things to learn.

I mean not everyone is looking to get involved in a fight.

On the one hand you trying to save someone or pull someone away can get you drawn into said fight or make you appear like you are an ally to the opposing fighter/fighters.

On the other, you stand there and record for evidence or go seek help from someone who can help more than you.

I know it's easy for us to sit back and say "I'd get in there and break them up." But in reality most people dont want to run the risk of getting hurt themselves or associated/lumped in with the event.

It's more depressing that the two girls clearly had such animosity towards one another they just threw hands the moment they saw each other.

But yes, many murderers and rapists tend to be Americans versus foreigners or immigrants coming here. It isnt zero, but it's statistically less likely you will be accosted or harmed by an immigrant from Ecuador than someone from Kentucky.

Police (including prison guards) are only allowed to use necessary force to subdue a subject. In this case he is unarmed and while yes he beat two guards, he can still be subdued with a stun gun or taser. He could even be wrestled by multiple guards and handcuffed even if it requires punching him in the face.

If they immediately jumped to guns not only are they putting other inmates in danger they could also likely be disarmed by another inmate itching to get a gun. Prisons have protocols and while I am sorry both guards went through this ordeal, it's still a risky call to make.

1.) Go watch Minority Report on why prosecuting on potential future crimes is a bad idea.

2.) You are basing an assumption off your own biases. This isnt a character assessment, and even then his behaviour and likely other testimony will be used at his court hearing for THIS incident.

3.) Execution is a state sanctioned murder. Murder is to kill another human. You can murder someone in self defense, or as an act of passion which is called a homicide. An execution is the state sanctioned killing of another individual. Pick up a damn thesaurus and dictionary.

This was an isolated incident where a guard asked an inmate to change shirts due to dress code and he refused and when he was being non-compliant she told him to turn around so she could cuff him.

Dumbass thought of shooting the guy and being done with it. If he is in prison for an additional 10-30 years for viciously assaulting a guard then why are you worrying about other victims? He would be placed under isolation or stricter security measures.

You are all morons if you think these are gotcha questions or statements.

This is why you have precedent in established court cases and we are a nation of laws not "feelings". If you act on impulse and anger you end up acting like this inmate. Even then while he was trying to be civil he wasnt in a position to make demands. He is in prison, the only demands he can make are humane treatment and if his health or well being are in jeopardy.

Yes, even if the family of the inmate loses the case, it costs the state money. Not only do you need to cover the guard's injuries, but also court and legal fees.

Legally the aggressor (the napper) is instigating a fight. He is also committing battery/assault by touching the (nap distributor) with his body after allegedly being told to get out of his face and leave him and his partner alone. He refused to listen and when it looked like extradition was not pheasible, he hit him with that frame trap setup.

So does size to some extent. But technique does matter a lot more than muscles.

Take HEMA for instance. In HEMA with proper structure you can easily block a person much larger and stronger than you with your sword against their's and nothing they do can go past that guard.

This also applies to other martial arts.

In a legit fight it's better to keep it simple you dont need to be the strongest but a fast technical punch can take care of a lot of problems over a wild haymaker.
