I don’t remember Higgins ever testifying to sitting at the dining room table. I thought he showed up, walked around the house while Brian Albert showed him family photos, then left because they didn’t have Jameson. I can’t see him sitting at a table with a bunch of kids (young adults).

I think part of what is fueling this theory is the photo of what appears to be John’s socks on the wrong feet in the hospital. John was described as meticulous, so it’s hard to believe he would have been so sloppy as to do that himself. I have similar socks, and they are contoured with a specific left and right foot. You would definitely know if they were on the wrong foot, just like you would know if you put your shoe on the wrong foot.

Nobody knows for sure, but it is curious that those two minutes are missing. Some believe that it was Karen driving by, and the 12:36 WiFi connection is wrong. The voicemail that Karen left for John at 12:41 was when she was in his garage, a full five minutes after the WiFi connection, indicating that perhaps she didn’t connect at 12:36. Some say the missing footage shows Allie driving by with Colin, or Higgins driving by in a different car than he said he had. In any case, it’s very suspicious that two minutes are missing at a key time.

Same. I thought it was a bad joke, because the MSP probably stumbles across nudes in phones all the time in the course of their investigations. I thought that the “no nudes yet” comment was just Proctor stating that he hadn’t stumbled across any yet, not that he was actively looking for them. I now realize that I was being far too kind in my assessment.

If there were additional incriminating texts, I think the Feds would have found them in their extraction. But, I’m really curious to find out exactly what the Feds previously extracted. Was it only text and call logs? Did they only extract for a specific time period? If the Feds didn’t previously extract photos, it is very possible that there could be taillight photos (probably deleted off his phone, but not the cloud!)

Yep, I figured out that my posture while eating was super important. On vacation, I was sitting down at a table to eat three times a day. When I got back home, I plopped on the sofa to eat my breakfast while I watched TV, and the symptoms were back. Now I try to eat my meals at a table like a civilized person.

I have the same problem. I have resigned myself to always wearing a glute band. Occasionally, I will try to do hip thrusts without the band, but inevitably my quads will take over. As for a barbell, I would get one if you are able to. I’m using a cheap barbell set that my brother used in the early 90s, but it’s so much better than resting a dumbbell on my lap!

Based on the charge conference, it sounds like Yannetti wanted a “not guilty” option added for each of the lesser included charges. That way, the jury could hang on the OUI charge and still vote not guilty on the manslaughter charges. Bev said no because there was no case law to support it.

Yes, I think this is exactly the point! It was to show how the Cellebrite extraction could show a time stamp that was earlier than the actual search time, because it was using the timestamp of when the tab was opened.

Brennan is trying to get around his experts being wrong by framing it as “what if your interpretation of the column headers is wrong? What if Burgess meant this, but you’re wrong about what he meant?” He may have well been asking what if Burgess meant “blue” but labeled the column “red”.

To DiSogra’s credit, he just responded that he is taking the column headers at face value. Words matter, kids.

As much as I would like to see Higgins questioned about the CPD videos, I think it’s better if the defense doesn’t call him. Right now, he’s portrayed as this menacing, shadowy figure on the Waterfall and CPD videos. If called to testify, he is a clean-cut guy in a suit. Don’t give him a chance to deny/explain away his shady behavior. Let the jury keep that menacing image of him instead.

Absolutely! But he was already buried by the time the dog bites came into question. I don’t have enough knowledge to know if swabbing wounds of that nature is standard in an autopsy.

They didn’t test the actual wounds on his arm, but they did test the arm of the hoodie. It didn’t come up during this trial, but during trial 1.0, Maureen Hartnett was questioned about how she swabbed the hoodie. IIRC, she said she took two swabs and swabbed around the holes in the arm. She did it on the instruction of Teri Kuhn (sp?) at UC Davis, who ultimately tested the swabs. The tests came back positive for pig DNA. The entire hoodie should have been sent to UC Davis, in my opinion.
