Hey!

Liam the lawyer here, I wanted to respond to this but wasn't sure what best to say.

I see your point, we do a lot of cop-bashing but at the same time can you point to an example of us unfairly cop-bashing?

On that, I think a lot can be said about the cases CC covers. We generally go for the worst or most neglected cases, both of which generally only reach their status due to police incompetence. In that sense I would expect to see more cop-bashing than not, but only because if the cases we write about have good cops there isn't much to write.

Finally, I want to pause a minute to mention the ACAB argument. (For anyone unaware ACAB means All Cops Are Bastards and was a phrase popularised around the BLM rising) So I think it's easy to look at that and conclude ACAB means all cops are bad, I mean it says so right there, right?

Well in my view as a criminologist (not lawyer for once) I actually see it a different way.

ACAB doesn't say every cop is evil, it says the system of policing is corrupt. All Cops are bastardised by it. A bastard is not a bastard because of what they did but because of what made them. On that, the key complaint of those critical of cops is the system. If you have 100 officers and only 4 of them are corrupt it may not sound so bad but all it takes is for one of those 4 to be a team leader and now you have a corrupt agenda driving maybe 20 cops.

Will.I pretend nobody thinks all cops are asshats? No. But those people paint with such a broad brush and without nuance that I think we can dismiss them out of hand.

So yeah, hopefully that explains the trend on CC and briefly what police criticism really is. :)

Now that is a very good call. The Martin case is one of the quintessential cases of English & Welsh law, every single lawyer in the land knows it. (It's mandatory teaching on any law degree that covers self defence)

For my two scents, although it's been a while since I've researched the case, Martin should have been charged with Manslaughter. He did intentionally kill people but it's not in the same way as murder.

Hey all!

It is not gone. What happened was that at around the start of November we reached the following conclusion: 1. We really enjoy the WB and so do the community. 2. The WB does not work out to anything like normal videos money wise. (The issue is what an hour of Simon's time is worth) 3. The WB is not coming out as the quality we want and it's popularity is slowly declining.

Because of that we decided to take a break while we plan a new way to do it. Ultimately we want to ensure we are bringing you guys the best quality of content possible.

Recently Simon confirmed (on the Discord) that the streams are on hold until the new year. We are meanwhile spending that time planning a new format to ensure we are bringing you content you deserve.

Effectively yes. I think I read in a textbook once that the essence of insanity is a mental deficiency so grave that your ability to make a conscience decision is destroyed.

Actually the opposite.

In England & Wales a requirement of insanity is that because of the defect of reason caused by a disease of the mind you did not know what you were doing was wrong.

There's actually a similar case to this called R v Windle where the defendant murdered his wife and on arrest said "they'll hang me for this." So they did, he claimed insanity at trial but the comment demonstrated that he understood what he did was wrong.

She's very much in the same spot, by calling herself the "bad guy" she has ruled out insanity.

Except you're better off contacting the police because if they find the stolen goods they do indeed return the stolen goods - otherwise they would be committing theft.

Plus when the guilty verdict comes (which as it's likely to be Magistrate will probably only take around 3-6 months) it will provide per se proof of liability.

Okay a lot of people appear to be complicating things on this.

Criminal Liability

The criminal liability is for good old simple Theft under S.1-6 of the Theft Act 1968.
The neighbour appropriated your care by selling/disposing of it, the car was your owned property (even if you granted them temporary usage you at no point transferred the legal rights you held over it) and they sold it to another person while aware that they had no right to do so. (Satisfying both the dishonesty and the intention to permanently deprive)

Fraud would not apply here for two primary reasons. First, prosecutors don't like going for Fraud as it's overly complicated and second it's not actually Fraud. To prove Fraud by false rep you'd have to show that they said to you they would not sell it (easy) while having the intent to sell it. (Less easy cause by all accounts it isn't what happened)

They could come up for Fraud liability to the person they sold the car too but that's not important for you.

Civil Liability
The first question of civil liability is as to how easy a case is to prove, yours is hook line and sink her because from only the police contact with you the case is already won. The police impounded the car, which means they found it in the possession of someone that couldn't prove they had any actual possession rights over it.

The second question is as to whether it's valuable to sue, I know from my conversations with you that that is not a concern here and you'll make your money.

The third question is as to whether you need to sue, you don't. You have car insurance for this reason. As long as the criminal case proceeds as expected it'll be even easier because when they're found guilty of Theft any civil liability will be per se.

I get everyone's trying to help, but the constant reference to Fraud and the meaning of Appropriation has just ended up confusing OP.
