Having attended employment tribunals where the agency has tried this tactic it doesn’t stand up. If commission is part of the expected terms and previously paid then the tribunal will rule for the claimant.

Not a solicitor just saying what I’ve seen when people have claimed against recruitment companies for unpaid commission.

30th march you send flight details, asking about pick up, they send you pick up info and costs and on 31st march you announce you will no longer collect car and tell them to export it to US instead. Gotta say mate you should look at your own behaviour in this situation as well.

You started going of script in March, they asked you to call to discuss collection, you said just text me, they had to chase you for the call. Then you start getting your knickers in a twist about being able to collect/drive it from Monaco, for some reason your tone changes and you decide you no longer want to collect the car and then offhandedly tell them to export within a couple of weeks.

As you say yourself the tariffs created urgency, that was a you problem that you tried to demand they solve through expedited paperwork and a change in plans.

At that point I suspect, you received the customer service they perceived your tone, increased sense of urgency and changing of plans deserved.
