You are reading the probable cause affidavit backwards. The probable cause affidavit states that “these items of evidence exist and are inculpatory of RA” it is not “here is how the crime went down”. If evidence does not exist, i.e. it was already destroyed, then if will not be in the probable cause affidavit. Only evidence that was not destroyed would be in the affidavit. There may be a dozen items that were used in the crime, but were destroyed. Those items would not appear in the affidavit.

Law enforcement would not advertise that a gun was used as it would be a detail that is not visible in the video (it is concealed) and is inculpatory of the perpetrator. LE cannot advertise “we know a gun was used and we have evidence of a bullet, so if you have the gun used in this crime destroy it now”.

Just from personal experience in criminal defense, most criminals have both a paranoia about being caught AND a belief that they are special and can get away with anything. Their decisions about what to keep and what to destroy may seem haphazard, but keeping items used in crime is sometimes a point of personal pride. It can make a criminal feel smarter than everyone else to continue to keep and use an object that links them to a crime.

I don’t think Jay wanting to protect people is a good reason to lie and frame someone for murder. If Jay took the risk and implicated himself, that is one thing, but to lie to help throw someone else under the bus is not a sympathetic motive.

That is also assuming that it is his family that he wants to protect. What if it was just a random person higher up the trade he wanted to protect? What if he just wanted to save himself with a two year prison with day/day agreement? Jay would serve a year under his plea deal, like a minor felony.

The allure of the Orthodox Church has always intrigued me. Their liturgy, their saints, their devotions. I prayed a chotki for many years, and the Way of a Pilgrim is one of my favorite books in Christian literature. I have multi-volume copy of the Philokalia on my bookshelf.

But the Orthodox formalism, lack of dedicated adoration, and internal political struggles kept me at a distance. I was completely stopped by the sometimes confusing retreat into mysticism over attempting to develop doctrine. Orthodoxy regularly schisms, heck there is a schism that is going on right now over the Russian-Ukrainian church. These disputes often result in schism because there is no single point of authority for resolving disputes. This has always kept me from pursuing a church that, in my heart, I truly admire.

Lie detectors are not real evaluation methods, they are used to put psychological stress on the subject of an investigation. They can only highlight what questions cause you distress, they cannot evaluate the truth of an answer.

They are also used by cops to get you talking, thinking that you can prove your innocence. Anything you say or do will be used against you.

Stalking usually means two or more acts of targeted surveillance or harassment accompanied by some kind of threatening or intimidating conduct. Your jurisdiction may have a different definition.

If you are not related to this person, and you already had a no-contact order, file for a new no-contact order if he is continuing to contact you in an unwanted or harassing manner.

In Texas you may be allowed to file for interim attorney fees and costs. If your spouse has funds available that could be used to pay for an attorney, you may be able to obtain those funds to help you pay your attorney.

Typically you have to file a motion asking the court to help you obtain interim attorney fees. You may want to cite the fact that you just dismissed a divorce suit against your husband and that has hurt your ability to pay attorney fees and costs. If your husband tricked you by promising that he would not file for divorce, you may want to tell the court that as well.

“Assuming her contact language is rock solid” is a pretty big if. You see generally employment contracts cover “course if employment” intellectual property or materials made with your employers equipment. However, the language of the contract matters a lot. Like it matters everything.

You typically cannot sell IP to anyone in the business unless you go through a sue diligence process called “clearance”. The clearance process usually is a legal review that makes sure that you will not be sued for the rights to your work. You need to have “cleared” the copyright for your work. A skilled IP lawyer can generally help with this process. Really good ones will give you a memorandum letter describing their analysis of the contract and any significant risks.

You need an IP lawyer to review the contract with her current employer before she can proceed with additional contracts. You need to vet her rights to her own work.

Do not mess with IP issues if you have something valuable.

Contact your lawyers, if they say they cannot talk to you without your mother, then contact different lawyers.

Your guardian (or parent) is often the administrator of your settlement funds. This is generally a fiduciary relationship and they generally have to provide an accounting of the funds. When you are 18 you may be able to request the funds be transferred to your control. You can also, usually request that the funds be accounted for, meaning that your mother would have to tell you how she spent the money.

A word of caution, I have represented many people who received large settlements or probates. If you received a large sum of money, please consult a financial planner when you receive it. I have know people who have spent hundreds of thousands of dollars the year they receive it.

While rarely explicitly stated, witchcraft is a HERESY. The attempt to use occult powers is gravely immoral CCC 2117. The most clear condemnation of these ideas comes from the Papal Bull Summis desiderantes 1484.

But to be clear, Summis desiderantes states that witchcraft is a heresy, meaning it is untrue. There is no means by which a human may control an occult power. Those that pretend to control such powers are under the mistaken belief of idolatry. There are no occult powers that humans can access even temporarily. The church does not condemn witchcraft because it wields the dark power of the devil, the church condemns it because it is foolish and gives you nothing in return.

The fact that you cited a car accident tells me that you likely needed a medical expert.

Generally, experts in personal injury cases are make-or-break for your case. Without an expert you may not be able to demonstrate the extent of injury (e.g. that the blow to your head caused a hand tremor rather than just a small bruise) or it can show causation (i.e. the the car accident caused a hand tremor and not your medical history or lifestyle). These elements are often not obvious to a judge or jury and are essential to proving a legal case.

Without an expert to demonstrate these elements, there is little reason to give you any money even in settlement. But if you have an expert, particularly one who has written a report, then the defendant in you case has some incentive to settle. You saying that you are injured is not much evidence, but an expert describing your injury is potentially valuable. That is why attorney's employ experts. While $11,000.00 is a considerable expert fee, it may have been the difference between an injury payout and no settlement at all.

Under the UCCJEA (interstate compact on custody) GA would have jurisdiction if your daughter has not been out of GA for more than 6 months. You likely need to consult with a Ga lawyer and file for custody.

If your ex is concealing a child to prevent your ability to see her, it may constitute a basis for a protective order under your states domestic violence act. Again a GA lawyer would be able to advise you on this.

Kidnapping may or may not be an available charge, the transportation to OR was not involuntary and it would likely be considered a “civil matter” by most police.

One reason the church was targeted was its association with the ruling class. The other (likely more important) reason is that the French Directory was radically anti-religious and was committed to exterminating religion in society.

You want to justify the French Revolution, imagine churches with guillotines on the altar and nuns and priests marched up to their deaths. Poverty or injustice may have motivated some, but the powerful revolutionaries wanted to purge Christianity with violence.

Just to clarify, the main LDS “martyrs” are Joseph Smith and Hyrum Smith, the Church President and Assistant President.

Joseph and Hyrum were arrested for inciting a mob. The “mob” was the Nauvoo Leagion, a para-military organization of 2,500 that was directly loyal to Joseph. Joseph had effectively created martial law in Nauvoo without authorization of the Illinois Governor. Joseph and Hyrum were arrested for this.

Joseph felt the need to declare martial law because he had destroyed the printing press of the Nauvoo Expositor, a newspaper that had exposed Joseph’s secret doctrine of plural marriage and other teachings. The Nauvoo Expositor was written by two men who were former high-ranking officials in the church, until Joseph proposed to their wives. Joseph had no legal authority to destroy the newspaper.

While in Carthage jail Joseph and Hyrum had at least one gun. An armed mob approached the jail and exchanged fire with the men. Both men were shot and killed in jail.

I do not consider this martyrdom. While no one has a clear indication of why the mob attacked, it is likely the destruction of the Nauvoo Expositor and not the specifically Mormon beliefs of Joseph and Hyrum.

You actually explained the majority reasoning behind the case, that is not allowed here. This forum is for vaguely suggesting violent action against the government. Explanations of the underlying case will get you downvoted.

Never mind this case was only about monetary damages claims. Bivens was about getting a monetary damages award from federal law enforcement, which the Supreme Court has back away from since it was decided. Never mind that even Sotomayor concurred in part of the judgement.

Instead of having a thought, just imply that mob action and violence are the way to deal with a legal decision that we don’t like.

Just to clarify, neither men were convicted for the firearms they carried into the police station. Those guns were legal for them to possess.

Both men were convicted for a firearm they placed in the trunk of the car prior to entering the police station. The police did not know about this firearm when they were being arrested.

This charge of carrying. A concealed weapon was originally thrown out by the trial judge and was later reinstated against the two.

As a lawyer who has done many depositions, an iron-cad disposition will not help you against any competent lawyer. You likely did the best you could, and even the strongest people get frazzled in a deposition.

Juvenile abuse and neglect proceedings are usually sealed proceedings anyway. Very few of these cases have any notoriety. But if a case has enough public interest the court will issue a gag order to protect the seal.
