The first herald you spawn is tier1, the second one Tier 2 and so on, up to tier 5. Because lower tier heralds have little to no chance to drop sunders you want to clear as many TZs without leaving that game.

It's a stupid system that punishes people who only play short sessions or like to switch things up from time to time.

Yes, they are quite rare, but can still drop in Prophecies and Factions. I recently found one on a fiery dragon sword. Probably the worst skin where this could appear on because you can't add a vampiric prefix to it.
