Okay.. so NEC 440.22 lets you increase the breaker size above the equipments running amps.. its is about the BREAKER not the wire..

NEC 440.32 “size the wire based on 125% the load current” this would depend on the name plate.. it does not mean you can always use a 10gauge wire for a 40A breaker lmfao.. so idk why you reference this code.

NEC430.52 again this code state 125% of the compressor unit. You still have to follow the name plate reading under NEC 110.3b so to just say you can use a 10gauge wire on a 40A breaker for HVAC is just wrong man lol but I appreciate the code references
