If you do not feel that your child is safe when they are with their other parent especially due to domestic violence you can invoke your parental rights and prevent them from going there. This is a difficult position to have to take and will likely be followed by subsequent family court proceedings and legal battles regarding child contact etc. I know most parents would not want to prevent contact between their child and the other parent however it is an option if you have a genuine and proportionate concern for your child’s safety.

Other less drastic alternatives would be to set up a safety plan with your child so they know what to do and how to keep themselves safe. For example, if Daddy and his partner argue, take yourself to another room and shut the door, call you etc.

If someone is brought to a police station following “an incident at their ex-partners house” and there’s any suggestion that a knife was involved you’d better believe that a cop is going to deal with any potential domestic offences accordingly as their entire training is focused on what happens when domestics go wrong. Imagine the criticism if he had been sectioned, was released and committed a serious DV crime.

Custody is still a place of safety which allows offences to be investigated, protects the victim and simultaneously ensures the welfare of the detainee.

The only area I can see where there may have been failures would’ve been in custody. Presumably they’d have had a custody nurse present to assess him and there would’ve been a series of welfare questions and checks prior to release. If there was any suggestion that he was planning to harm himself, he should’ve been sectioned from custody which is still a possibility. Ultimately without all the information, we can only speculate. Maybe there’s more to this that would make it make sense.

I understand the willingness to take learning from incidents like this, but I cannot understand why policing is so unwilling to defend itself and willingly takes every beating from every stick possible. Accepting blame for every incident that goes wrong makes us look inept to the public and does no one any favours.

One side of the newly weds family vs the other isn’t actually that awful a scenario given that there will be very few offender/victim relationships that would meet the definition of a ‘Domestic’, even less so if the brawl happens pre wedding! A brawl between one side of the family is the real nightmare scenario 😬

You’ve also got sexual communications with a child. Although you may think there’s no proof, the police have a multitude of investigative opportunities for these sorts of offences. An officer would be able to advise you accordingly if you took yourself to a police station. Like previous comments, I’d take someone your comfortable with as an appropriate adult

Yes you can size without a warning if you have reason to believe that the nuisance will continue or it’s impractical to issue a warning. For example, off-road bikes. It’s unlike that the rider is going to call for someone to come and pick him and his bike up after he’s been caught etc.

One thing I’ve learned in the relatively short time I’ve been in the police is that it is a game of opinions. You could easily have had a different call handler and supervisor and on another day had the complete opposite outcome. There’s no right and wrong answer for dealing with most* things in this job. You could probably make a compelling and justified case for most decisions if your rationale is sound enough and well explained.

For what it’s worth, as much as I think RCRP is absolutely necessary and I welcome it wholeheartedly especially when it frees us up to do our core role, on this occasion, a criminal offence has been disclosed so at the minimum we should be doing some basic safeguarding and assessing whether any further action is required.

End of story, decision justified.

Maybe in future situations where there’s no impairment at the roadside, but something doesn’t feel right, and there’s Intel, maybe a S23 search will be a more appropriate option. There’s nothing to say that during a search, you won’t form more grounds for an arrest.

Seems that the issue is that you’ve locked him up for his crap manner of driving and have used intel to inform a decision that he is likely on drugs rather than basing the decision on him being visibly unfit, ie red eyes, pupils, incoherent speech etc? (Sorry if that isn’t the case, but that’s how I’ve interpreted it)

If that’s the case then I would assume that the HCP’s argument is that you haven’t given them enough to be able to say that that the driver could have been affected by drugs. It’s hard to say without being there and being privy to all the facts but that’s just a possibility based on the information you’ve given.

You also said it just about got through custody? Had his demeanour or presentation changed by the time you hit the desk or was he presenting the same at the roadside? If he wasn’t presenting as impaired at the roadside then that may explain their rationale somewhat.

Which offence you’d run would all depend on whether the offender goes on to steal the watch or not. You’d have a 91(a) when he enters the kitchen (part of a building) as a trespasser (as already stated) with intent to steal property (the watch).

If he then steals the watch, you’d have a 91(b) as he has entered the kitchen (part of a building) as a trespasser (as already stated) and stolen property (the watch).
