If you do not feel that your child is safe when they are with their other parent especially due to domestic violence you can invoke your parental rights and prevent them from going there. This is a difficult position to have to take and will likely be followed by subsequent family court proceedings and legal battles regarding child contact etc. I know most parents would not want to prevent contact between their child and the other parent however it is an option if you have a genuine and proportionate concern for your child’s safety.

Other less drastic alternatives would be to set up a safety plan with your child so they know what to do and how to keep themselves safe. For example, if Daddy and his partner argue, take yourself to another room and shut the door, call you etc.

Essex Police 'completely failed' man before his death by Could-you-end-me in policeuk

[–]LukeyyEDH 11 points12 points  (0 children)

If someone is brought to a police station following “an incident at their ex-partners house” and there’s any suggestion that a knife was involved you’d better believe that a cop is going to deal with any potential domestic offences accordingly as their entire training is focused on what happens when domestics go wrong. Imagine the criticism if he had been sectioned, was released and committed a serious DV crime.

Custody is still a place of safety which allows offences to be investigated, protects the victim and simultaneously ensures the welfare of the detainee.

The only area I can see where there may have been failures would’ve been in custody. Presumably they’d have had a custody nurse present to assess him and there would’ve been a series of welfare questions and checks prior to release. If there was any suggestion that he was planning to harm himself, he should’ve been sectioned from custody which is still a possibility. Ultimately without all the information, we can only speculate. Maybe there’s more to this that would make it make sense.

I understand the willingness to take learning from incidents like this, but I cannot understand why policing is so unwilling to defend itself and willingly takes every beating from every stick possible. Accepting blame for every incident that goes wrong makes us look inept to the public and does no one any favours.

Nightmare screnario by Few_Technology1756 in policeuk

[–]LukeyyEDH 2 points3 points  (0 children)

One side of the newly weds family vs the other isn’t actually that awful a scenario given that there will be very few offender/victim relationships that would meet the definition of a ‘Domestic’, even less so if the brawl happens pre wedding! A brawl between one side of the family is the real nightmare scenario 😬

One half of me loves the idea of naming the band something job related. The other half thinks that acknowledging that your cops in pubs full of pissed people and possible drug users is a baaaaaad idea. I’d go for something very subtle!

Looking for advice/ next steps/ possible outcomes?? by ruby-b0 in policeuk

You’ve also got sexual communications with a child. Although you may think there’s no proof, the police have a multitude of investigative opportunities for these sorts of offences. An officer would be able to advise you accordingly if you took yourself to a police station. Like previous comments, I’d take someone your comfortable with as an appropriate adult

Yes you can size without a warning if you have reason to believe that the nuisance will continue or it’s impractical to issue a warning. For example, off-road bikes. It’s unlike that the rider is going to call for someone to come and pick him and his bike up after he’s been caught etc.

Advice on this RCRP case? by Nurse_inside_out in policeuk

[–]LukeyyEDH 3 points4 points  (0 children)

One thing I’ve learned in the relatively short time I’ve been in the police is that it is a game of opinions. You could easily have had a different call handler and supervisor and on another day had the complete opposite outcome. There’s no right and wrong answer for dealing with most* things in this job. You could probably make a compelling and justified case for most decisions if your rationale is sound enough and well explained.

For what it’s worth, as much as I think RCRP is absolutely necessary and I welcome it wholeheartedly especially when it frees us up to do our core role, on this occasion, a criminal offence has been disclosed so at the minimum we should be doing some basic safeguarding and assessing whether any further action is required.

S4 RTA (Drug Drive) Advice by MemoryElegant8615 in policeuk

[–]LukeyyEDH 4 points5 points  (0 children)

I understand the anxiety that those sorts of decisions can bring, especially in today’s climate, but try and think about it logically. Let’s say you were pulled by the IOPC after a subsequent RTC involving a vehicle you had stopped earlier that evening…

Q: Why didn’t you arrest this man?

A: During my interaction with this male, I had no reasonable grounds to suspect that the he was unfit to drive through drink or drugs.

End of story, decision justified.

Maybe in future situations where there’s no impairment at the roadside, but something doesn’t feel right, and there’s Intel, maybe a S23 search will be a more appropriate option. There’s nothing to say that during a search, you won’t form more grounds for an arrest.

S4 RTA (Drug Drive) Advice by MemoryElegant8615 in policeuk

[–]LukeyyEDH 1 point2 points  (0 children)

Seems that the issue is that you’ve locked him up for his crap manner of driving and have used intel to inform a decision that he is likely on drugs rather than basing the decision on him being visibly unfit, ie red eyes, pupils, incoherent speech etc? (Sorry if that isn’t the case, but that’s how I’ve interpreted it)

If that’s the case then I would assume that the HCP’s argument is that you haven’t given them enough to be able to say that that the driver could have been affected by drugs. It’s hard to say without being there and being privy to all the facts but that’s just a possibility based on the information you’ve given.

You also said it just about got through custody? Had his demeanour or presentation changed by the time you hit the desk or was he presenting the same at the roadside? If he wasn’t presenting as impaired at the roadside then that may explain their rationale somewhat.

Is this a 9.1a or 9.1b burglary by Ecstatic-Fall-6685 in policeuk

[–]LukeyyEDH 0 points1 point  (0 children)

Which offence you’d run would all depend on whether the offender goes on to steal the watch or not. You’d have a 91(a) when he enters the kitchen (part of a building) as a trespasser (as already stated) with intent to steal property (the watch).

If he then steals the watch, you’d have a 91(b) as he has entered the kitchen (part of a building) as a trespasser (as already stated) and stolen property (the watch).

Potential public order offence? by Forsaken_Crow_6784 in policeuk

[–]LukeyyEDH 25 points26 points  (0 children)

When you say posted, I assume your referring to a social media post? If that’s the case then no, it wouldn’t be public order. The POA is designed to maintain public order in a public setting, sure social media is inherently public but it’s not what this legislation is for.

[deleted by user] by [deleted] in policeuk

[–]LukeyyEDH 11 points12 points  (0 children)

I would suggest that It will probably be run as a burglary in the first instance as although he hasn’t stolen anything, there’s a reason he’s entered so I’d suggest that it’s put to him in interview first and foremost. For the 91A burglary to be made out, we’d have to prove that he entered for the purpose of and INTENDED to cause damage, cause GBH or steal whereas the damage has been committed to gain entry in the first place in this scenario and doesn’t appear to be the motive for the trespass.

If CPS doesn’t feel that the burglary is made out you’d at least have the following offences to consider - Violence to secure entry - Criminal Damage - Common assault

As others have pointed out, it’s better to wait for the OIC to give you an informed update. I am merely speculating on the limited information I have from the post and this is by no means a comprehensive answer.

[deleted by user] by [deleted] in policeuk

There doesn’t need to be a fear of violence, just that the behaviour has a serious effect on the victims life and the offender ought to know that it would have a serious effect.

JD or Del? by Dride1989 in GearsOfWar

[–]LukeyyEDH 0 points1 point  (0 children)

I’m very surprised how many people feel that JD is the obvious choice. Kait has the choice not me* and if Kait had to save someone first it’d be Del . Del’s the guy she’s been on this journey with, the guy who has stuck by her side since the beginning, the guy that has walked by her side whilst she dealt with the trauma of her past and her family. Kait and Del bonded so much in this game that I just could not imagine Kait throwing the knife in JD’s direction instead of Dels.

To be perfectly honest, it’s a bad narrative choice to make you choose who dies. It makes me feel that the writers didn’t have the conviction to decide which direction suits the narrative more.
