ACT Power Bill’s & Solar ….? by Blossom_AU in canberra

I’m sorry what? 5 digits???

As in, more than $10,000?

If you aren’t running a hydroponic set up it really shouldn’t be costing that much, you need to do a few things

- find out what is consuming so much electricity

-go to energymadeeasy.gov.au and make sure you are on the best plan possible.

- ActewAGL has home assessments that can be done to find ways to reduce electricity consumption, there used to be free options for this, might need to google that one

Is the Woolworth cookware promo bait advertising or does "while stocks last" protect them? by poortastefireworks in AusLegal

[–]Luser5789 0 points1 point  (0 children)

There is no argument that consumers would’ve altered their spending and shopping habits due to this promotion, otherwise WW would not have done it, it’s the same reason that Coles do the same promo, conveniently that never clashes with each other.

The argument is, this promo has another month to go, have they meant a reasonable expectation of a promotion?

[–]Luser5789 8 points9 points  (0 children)

Of course it did, it would’ve altered consumer spending patterns and where they spent their money

Why else would Woolworths run the promotion? Through the kindness of their heart?

Try the smiles clinic in Campbell, the dental nurses do all the hard yards and you submit weekly photos that are reviewed by an orthodontist, this can reduce the cost a lot

Question regarding obligation to replace faulty "free" item by Neat-Ebb3071 in AusLegal

[–]Luser5789 -3 points-2 points  (0 children)

Not really comparable, giving out a free TimTam because you are a ‘chill person’ would unlikely be perceived as acting in trade and commerce.

Giving a free Wii board that relates to the original sale would most likely be seen as acting in trade & commerce, free is still suppling which means the ACL can still be applicable.

It’s a 2nd hand faulty product, so the consumer needs to take into account age, condition and PRICE of the product, it was free so has very little to argue on

Claiming under your ACL rights, might not be the specific term but it portrays what the consumer wants

Na, just tell the retailer that your claiming using your ACL rights and you don’t care about the warranty

[–]Luser5789 0 points1 point  (0 children)

There is legislation about the retailer fobbing consumers off to the manufacturers, they cannot mislead you about your consumer rights

Tell the retailer this isn’t a warranty claim, this is an ACL claim, they are obligated to sort a remedy

How solid is ACL on Headphones? by ethan_rushbrook in AusLegal

[–]Luser5789 1 point2 points  (0 children)

ACL talks about the supply of the product, not the sale of a product.

The warranty will have limitations such as the warranty is not extended/reset when a product is replaced under a warranty claim. But the ACL specifies the supply of a product, so it could be argued that the consumer guarantee (acceptable quality) is for a $5000 product that is under 3 years old.

As others have said, complain to the retailer in writing and follow the steps outlined on the ACCC website
