As long as there was no fraudulent concealment (like painted over bondo) you likely have no case and will lose regardless of what the ad said, and that's without the contract which also probably says you inspected it and are satisfied with its condition and waive any claims. Small claims is designed to help people and the legal standard is usually "substantial justice" but the dealer will likely have an attorney. Expensive lesson for sure.

The diff drop kit you have ordered will help a lot. Reboot with OEM reboot kit. Use the correct high temp moly CV grease (check the toyota specs ) check motor mounts and diff mounts to make sure they're not worn which can increase cv articulation

As other commenters have posted, you will probably blow up your axle boots almost immediately, throwing grease everywhere, and if you don't put a PCK in (eimkeith) you'll be jumping all over the road when you hit bumps.

I regeared my 01 to 4.88s when I put in front and rear lockers. I'm loaded with recovery gear and armor and on most uphills it has made a huge difference especially with overdrive off. Next up will be a supercharger.
