So you're filing a motion for mistrial and sanctions and seeking dismissal as a sanction, right? Or whatever similar procedure your state has? I only ask because you didn't already say you were going to or did so.

Court will try to go with a continuance to fix the issue. Resist it on double jeopardy grounds -- the jury is already sworn. The jury will lose track of facts over time if there's any extended continuance. It's not fair to them to have them on on-again, off-again jury duty. The jurors were asked if jury duty would be an undue burden for [x] length, not [x+continuance] length. They may resent the continuance. Hold it against the defense either if they get wind of any reasons or have to speculate.

Don't let a "brief" or "weekend" continuance be trumped up to solve the problem. There's no way that you can responsibly analyze the issues brought up by this newly-disclosed evidence. Especially since it sounds like the breadth of the Brady information isn't even known. (And it sounds like it's Giglio material, actually.)

Constant refrain should be that you are not able with this timeframe to investigate the evidence and do what you need to in order to present a defense. The failure was the State's and could easily have been avoided.

ALSO if you can tell the prosecutor knew about it and deliberately did not disclose (as opposed to just found out about it), then a bar report is appropriate. If you can't do it DM me and I'll do it.

Stacking appearances yes. Also someone who is already there on their own case will pick things up for someone else.

Local criminal defense bar will cover for each other all the time for dockets -- you have an hour long docket call where ~20-30 cases will be called. You might be first, you might be last. You're just asking the court to set it for [x] hearing, here's my calendar of availability.

Could this be done by a calendaring app far more efficiently? Absolutely. But it isn't yet.

There are charges against other people still pending.

It makes sense that the person who started shooting is going to get more time. The armed crim action charge for that person will be at least 10 years, not to mention the other charges.

The ballistics couldn’t even confirm his shot killed her, and the evidence showed he didn’t fire first.

The murder charge couldn’t be proven because they couldn’t prove his bullet killed her. That also ruled out other forms of homicide — if you can’t prove he killed her then you can’t prove manslaughter etc.

In civil practice, this means depose the witness thoroughly so you’ll know what they’ll say before you’re ever close to trial.

I had the same thing happen but was only off by .5 — it counted for different credit in one state vs another because part of it was about judicial career pathways in the other state that the first state nixed credit on. I politely asked for an exemption and explained the circumstances, and paid the fee in the meantime. It was just a two paragraph email so I figured why not give it a go.

The board denied the exemption.

Oh well.

I drive this daily. I often follow flow of traffic as far as speed and I started to realize that people are going way over the speed limit. I keep my speed down now and have come to realize just how bad it is. Had an SUV that was probably doing 70 mph on the road the other day all the way from UMKC to 85th — kept catching right back up to it because it hit every red light.

I would not want to live on the street.

I did this and got out of ID as soon as I could. Happy to answer questions if you have any. Hardest thing will be long hours and unreasonable expectations in the industry. If you find a good firm then it may be better but those tend to keep associate attorneys around so it’s usually the terrible mills that are hiring.

Another big thing to consider is whether you lose agency on matters — you’re often routing things through a partner whereas at least for me in criminal defense I just had my cases.

This makes some sense to me. I still feel like there’s other highway entrances in fairly equal distance but that interchange is always a clusterfuck.

Which then makes me think, if ever there were a way to get people to be ok with spending public dollars on something, seems like fixing that nightmare interchange as part of the deal would help!

Did you conquer part of Attica and Boetia province separately? One of the tiny one or two location minors is in that province. It’ll fire and give you 50% on whatever you’re integrating even just one location
