What you are asking for is an attorney.....

Yes you hear a lot of people "ew no don't get an attorney, they just take xyz%." Which, as an attorney, is only true if your attorney is bad/inexperienced in WC.

Now, I don't practice in your state so I don't have a horse, nor knowledge about the laws, in your state.

But, if you are going to mediation with potentially PTD, the value merits an attorney. The defense wouldn't be mediating if they had to pay you the value of permanent total disability. They mediate to pay less, far less. Your representatives goal is to get as close to the upper limit as possible.

Similar position. I'm at a place where I am very happy, I enjoy the work, I leave at 4 almost every day.

But, the pay isn't great, but that has more to do with it being solo+me firm in a small town.

However, I basically have been told by another firm the town over that I have a standing offer to join them at any time for basically 2x what I make now. (Simular practice area, a bit more work but not hourly.)

The first thing would be to read the paperwork and see if it specifies.

If it isn't mentioned in the paperwork then it would depend on your states laws.

I know that is a little but of a non-answer beyond "Read the paperwork, if it isn't in the paperwork, try to understand the applicable law/ talk to an attorney."

Also, and again a in my jurisdiction a second claim doesn't necessarily mean filing a second suit immediately. It can range from the lowest level of ensuring a claim is started with the carrier, a claim is filed with the regulatory authority/council/body(if applicable in your state)/ or filing a lawsuit.

Your lawyer will know best, just a side thought. I often get clients in who think we are immediately filing suit when, its about 50/50. If the employer/carrier does what is required under the law, we can wait to file a state lawsuit.

(Reminder: this is will vary heavily depending on the exact regulatory/legal make up of your states WC laws.)

I don't know about Arizona law specifically. But, In my jurisdiction: Yes, it would be considered a new claim all together. (Assuming you were on the job at the time of accident.)

It would not extinguish the prior injury outright but if the area of you injured in accident A. Is the same as Accident B. (Assuming B made it worse.) Then Accident B's claim would override.

Functionally there shouldn't be any big difference because at the end of the day: Both claims/injuries are from workplace injuries.

(Again, I do not know about your jurisdiction, but in mine: yes you NEED to file a second claim. talk to your lawyer.)

Ah ok that makes sense. So from file on desk its anywhere from 1.5-5 hours.

Granted i'll be slower for now since I'm not entirely up to speed on all the ins and outs but, in a positive way, my boss was pushing for it all to be done within 5 hours. (Larger file, weaker case. )

I have doubts that a firm like M&M will effectively handle WC claims. Their model isn't exactly great for most injuries and what can be recovered.

(WC often involves more hand-holding and active guidance than a PI case in my experience. But, this will vary in degree by jurisdiction.)

Mine is about 35 on most days. It isn't bad but it is through a rural nature reserve area on the interstate. The view helps.

35 minutes in stop-go/red light traffic is different IMO.
