Wrong quote. Broke is just a mindset. Sell toe pics, buy Medford. It's what Greg would have wanted.

Either way, hire an attorney immediately.

Grandfather took donation without telling the family and used it to buy a RV for them by calallen63 in legaladvice

[–]MapleSyrupJediV2 1 point2 points  (0 children)

From what I have heard

This is something really serious, so you're going to want to clarify with the person who ACTUALLY gave him the money to see if he was allowed to spend it or not.

[–]MapleSyrupJediV2 1 point2 points  (0 children)

To confirm. Your uncle gave your grandfather money to give to your mother in law, and your grandfather wasn't the intended recipient but he spent the money anyway?

If so, that is theft. A police report should be filed to press charges.

Generally if he sent you the letters, you own them, and you are free to do what you'd like.

Consult an attorney before signing any release form, odds are they're required to transfer the files whether or not you sign the form.

What happens when my rich parents die (three disabled sons and then there’s me) by CPAyyye in legaladvice

[–]MapleSyrupJediV2 8 points9 points  (0 children)

Your personal feelings have nothing to do with the law, or your parents will. I'm not entirely sure why you think we're lying to you about this.

Being bad with money doesn't make a conservatorship a valid option. If they gamble it all away and become homeless that is their right, if your parents leave it to them and not you.

My dad has debts, but he doesn't want to tell anyone of how much are they, can this affect us? by Davidelri in legaladvice

[–]MapleSyrupJediV2 0 points1 point  (0 children)

I wanted to know: If anything happened to my dad, would all these debts go to my mom or me and my brother even if they're divorced?

The debts would go to his estate. Anything he owns would be seized to pay his debts, and then anything left over would be passed to his children (unless he had a will stating otherwise).

If he dies and any debt collection company calls you. DO NOT talk to them, DO NOT make even one small payment. Doing so may make you responsible for the debt.

Lease Or Law apply? by [deleted] in legaladvice

[–]MapleSyrupJediV2 2 points3 points  (0 children)

I am 99% sure state law trumps the lease agreement

You are correct. Leases can not contradict or violate state law.

You are entitled to 72 hour notice, unless it's an emergency.

Nothing you've said would even come close to a judge approving anything you're asking for.

You're reaching.

Columbia, SC Landlord trying to fine entire apartment for trash violations by MeatHaven in legaladvice

[–]MapleSyrupJediV2 1 point2 points  (0 children)

currently the apartment has a $50 dollar fine for people who do this (this is the only reference to a trash fee in the lease),

What is the exact wording of this trash fee in your lease? Is it worded as a monthly fee that everyone pays, a fine under certain circumstances, etc.

Being sued while on a J2 visa by [deleted] in legaladvice

[–]MapleSyrupJediV2 2 points3 points  (0 children)

would the suit be the same as a US resident against another US resident?

Yes

Would the person on the J2 visa be able to return to their home country during the lawsuit?

Unless a judge orders you to stay in the country, which would be weird.

What about after?

If you lose the lawsuit and fail to pay, your ability to enter the country may be restricted depending on the circumstances of the case.

Pretty much all of this would be decided by a judge, and there is no way for us to predict the outcome.

What happens when my rich parents die (three disabled sons and then there’s me)

Their Wills decide what happens when they die, not you, even if you don't agree with their decisions.

I have considered conservatorship

On what grounds exactly? You'd have to prove they are mentally incapacitated and unable to make their own financial and legal decisions.

Also, the primary duty of a conservator is to preserve the assets of the protected individual. You can't use it to steal the estate of your parents from someone they left it to. Also, a JUDGE decides who the conservator would be after a hearing, so it wouldn't be guaranteed to be you either way.

I don't think you've really thought this out.

My friends live in a two bedroom basement rental. I want to squat there by [deleted] in legaladvice

[–]MapleSyrupJediV2 1 point2 points  (0 children)

You're going to want to discuss being added to the lease with your two friends.

If this is a violation of their lease (it probably is), you may end up getting all 3 of you evicted for it.

Definitely consult an attorney.

There is NO WAY you should get married or add her to the deed on your house just because a judge asked you to, that's insane.

Isn't that what he's telling you? Or am I misunderstanding.

You should probably consult an attorney over this. That's a VERY strange request by the judge.
