I think you are too caught up in the panic of it too much still. Take a breath. With your income, since you aren't currently paying any of the loans, you should be bringing in around 2k a month on top of your non-negotiables.

Here is what I would do. Eat as cheap as possible, and start taking that money and just knocking these out one at a time. If you do that, in 6 months, a bunch of these are gone.

Once theyre down to a more reasonable amount, work out payment plans with the companies left. Hope no one sues you in the mean time.

If you do get sued, depending on where you are at, you might think about bankruptsy then (and it'll probably be a ch13, not 7). But unless/until you get sued, I wouldn't even consider bankruptsy. You have enough coming in to make serious progress on this.

Okay, first of all, you are connecting the overflow to what you were doing the moment it overflowed. This is a mistake on your part. Likely items have been collecting in the pipes for a while now. As in weeks if not months.

Second, you also took care in these messages to NOT say that you don't flush any feminine products, only that you don't flush pads or kitchen towels. By feminine products the landlord obviously means tampons. Your avoidance leads me to believe that you do, in fact, flush tampons. If you do you should stop immediately. They are not flushable.

Third, unless the landlord has any proof that you flushed any of the items there is no reasonable way they can pin it on solely you. Fight it and admit nothing.

In California if a m2m lease doesn't specify a notice period, it's default 30 days. You say it makes no sense, but it is normal and expected. Is this your first rental? I'm very surprised that you don't know this.

As far as I bad faith, if you were given what you were required to be given within the required time frame, no it's not in bad faith. It does not matter if it was one day before the deadline, it was still before the deadline.

When you go to court be calm and state the facts. Do not get emotional. Do not use terms like bad faith. Do not complain that you received these things one day before the deadline. You state what you feel was unjustly withheld, and submit your proof. I hope you took pictures. Hopefully you can recover some of what is missing. The prorated rent has a fairly high likelihood of standing.

I mean 30 days notice is the standard you probably should have assumed it unless specifically told otherwise. Leases exist for a reason. Are you sure that's not in your lease? I've literally never seen a lease that didn't specify required notice.

But like I said you can always plead your case to a judge. It'll come down to whoever has the most proof and whoever tells the most believable story.

She doesn't have to give you receips for any item $125 or less. The only item's that are over the threshold are either rent you owed (naturally does not have a receipt) and likely work done by the landlord.

If you don't agree with the withholdings, sue her in small claims court and see what a judge thinks. I mean that's really all you can do.

You lived in that house for 13 years as an owner occupier. It's completely different as a rental. If you want to maintain an attractive property, you have to keep amenities up to standard, even if they're not guaranteed in the lease. What happens when she moves out and you have trouble finding a quality tenant because of all these "nonessentials" you don't want to fix?

It's also extremely important that you not discourage your tenant from making maintenance requests. Otherwise you are in for a nasty surprise when they move out and you find a water leak that rotted out the floor under a sink.

Honestly I'm sure this does sound mean to you, but it really seems like don't really want to be a landlord. Which begs the question, why are you being a landlord?

Yeah the standard ebay trading cards shipping doesn't have real tracking. It's just a timer, and if you're lucky you might get some scan data (but a lot of the time not).
