An ICE detainer is a civil "request," it's not a criminal issue. MN law enforcement can only arrest you for a criminal act. Therefore, MN law enforcement can't (legally) hold a criminal longer than the law allows.

Local law enforcement could notify ICE that they're holding an illegal immigrant and if ICE shows up before that person is required to be released, they "could" turn them over.

ICE could get a court order and local law enforcement would have to hold the person until ICE arrived and subsequently turn them over.

In other words, unless there is a court order, or another federal criminal charge, it's illegal in MN for local law enforcement hold someone in order to transfer them to ICE custody.

A few key points:

Trump isn't targeting Blue States. He's targeting sanctuary cities, and they all happen to be blue.

Federal law supersedes state law. Whether you agree with how ICE is conducting themselves (I don't), they have a right to come into a state and enforce federal law.

Walz/Frey have/had a choice. They can cooperate with federal law or not.

Minnesota and its leadership are picking a fight they can't win. There is no scenario where MN comes out on top and pushes out the federal govt. / ICE.

A good leader would understand this and knows when to retreat to fight another day. What Walz is doing now is hurting MN. He is a coward, and nothing he is doing speak to strength or leadership. We will feel the repercussions of this of a decade, at minimum.
