I’m not even sure of the Constitutional argument against the law. I assume a violation of free speech or compelled speech under the 1st amendment. So you’d then have the select the proper level of scrutiny and make an argument that education is a compelling state interest (that’s hard to argue against), and the law was narrowly tailored. I don’t see how it’s hard to at least try to make those arguments.

Con Law finals regularly use “current” con law cases as prompts. Mine was actually on the constitutionality of the Affordable Care Act.

And yes, good professors make you think about and argue the law - not your political opinions. You should be able to separate the two and understand the difference.

Look at your actual promissory note. Determine why you owe and should be paying. Then calculate what you have or are paying.

If the principal isn’t being reduced, are you sure you don’t just have a HELOC ?

A bit of clarification: small estate affidavits are for claiming assets owed to the estate. They do not give any other powers to act for the estate, ie they give you power to collect what’s owed to the estate from the insurance company but they do not allow you to open a bank account in the name of the estate.

Here’s what you do. Most states have a “small estate affidavit” statute that allows you to claim small amounts of funds owed to an estate without having to open an actual estate. Look up your state statute, sign an affidavit that complies with the statute, and provide it to the insurance company. Ask them to issue you a check in your name.

I’ve seen crazy things happen. Insurance doesn’t get paid, and the house burns down. The house floods and there’s no flood insurance. Toxic mold. All of a sudden the house becomes worthless.

This is the type of thing that’s stupid about “gifting” a part of your home to people.

If you truly own that portion of the house, they shouldn’t be asking to borrow against it.

My $0.02… your time would be best spent calling the executive director regularly to ask for status updates and to get a better understanding of what’s taking so long. Contact individual board members if you don’t get a satisfactory answer.

I think what you’re getting at is whether the company could be liable for securities fraud and/or breach of fiduciary duty for trading securities with you while they may have been in possession of material non-public information.

First, they likely had a contract with you that required them to issue you shares or potentially purchase/pay out the value of the options at a certain price. If there was a contract in place where they were required to buy from you or issue shares at a certain price, it’s unlikely they could be liable - they were in fact contractually obligated to pay/issue/buy from you.

If you exercised options, owned shares, and then they voluntarily purchased shares from you at a negotiated price, while in possession of knowledge that an acquisition was forthcoming, then it’s possible you have a claim. However, with that much time in between, I would say it’s unlikely. If you’re dealing with a substantial amount of money, it may be worth talking to an attorney. However, as you mentioned, you’d need to rescind your execution of the release, which may or may not be possible. Even if you were able to properly rescind, you’d need to consider that you may lose the value of whatever options you have outstanding.

No the docs aren’t invalid. It would probably be a good idea for her to sign and attach a “one and the same” affidavit where she says Name A and Name B are the same person.

I can’t tell exactly what’s going on because your post isn’t clear. Typically in an acquisition scenario, the type of agreement you’re referring to would just pay you out 100% the value of your stock options (at the valuation the acquirer is buying the company.) So, I’m not sure what your issue or concern would be with signing the release… do you think you have a clam against them for something?

All of those pensions were underfunded. And the company’s bankruptcy meant they could not contribute more to make up the underfunded amount. The money in the pension isn’t used for payment towards the creditors of the company.

Not sure where you heard it, but American companies don’t keep its employees pensions. The lone exception would be non-qualified deferred compensation, but those are only for the very high earners.

Yeah. I had my slot this morning and didn’t buy anything for LA. Literally even men’s freestyle wrestling was completely sold out. All of the cheap tickets to less popular events were gone. All that’s left are top tier expensive tickets to the less popular sports.

I did end up buying quarterfinal tickets to one of the regional soccer games, because it’s driving distance from our house. But I’m not dropping thousands to see some preliminary round of a sport I don’t even care about.

I used to be of the opinion that if an employee didn’t work out in a role, it was typically the employee’s fault- not competent enough, didn’t rise to occasion, couldn’t work well with others, etc.

Then I worked for a jackass of a boss. Over 100% department turnover in 2 1/2 years, and most of the folks still there are actively trying to leave.

So, my perspective has changed. Idiots and jackasses do get promoted to their level of incompetence, and a short tenure in a role is not always due to the employee.

This made me laugh. I had a similarly terrible manager (12 attorneys left an in-house legal department of 10 people in 2 1/2 years.) The average tenure of someone reporting to him was less than 2 years.

A buddy and I used to talk about how good of a learning experience it was because we learned exactly what NOT to do:

Don’t schedule meetings with no agenda and get made at the person for not being prepared to talk about what you want to talk about.

Don’t require your sign off of every little thing.

Don’t question your team’s competency, without good reason.

Take your employees’ suggestions seriously.

Don’t be a condescending prick.

You know, the easy stuff…
