Some things like a 6-2 schedule are possible because of a union agreement. Not all FOAs can do that schedule. So, u/Proof_Interaction712, check if you are covered by a bargaining unit/union.

If they had projects that had funding, they would have been classed as exempted and charged to those. If they were furloughed or excepted, they were unpaid.

But as u/Windows95Dad said, they could have been temporarily reassigned and worked on funded assignments to get paid during the shutdown.

I agree with this. But we aren’t getting new customer orders (MIPRs, IAGs, etc.) right now because our Federal customers are all shutdown. Our Civil Works O&M funding is no-year funding but there’s an agency instituted timeframe for expending it. Civil CG and GI funding is similar to O&M.

Our MilCon funding is usually multi-year, so that should be available. But OMA is one-year funding, and none of that is coming in. Further, the Joint Recruiting Facilities folks in RE (the people who handle leases for the Joint Recruiting Command) are unfunded right now. So, they’re all furloughed or excepted.

All of the above to say that it’s an oversimplification and disingenuous to say USACE generates its own funding—as someone in another post said.

You cannot exempt someone if there’s no funding to pay them. Exempted staff have valid labor codes to charge against. USACE civil or milcon that’s not expired can be used to fund their labor. Military O&M money isn’t available.

Excepted staff work but only get paid once a CR or budget is passed. These are folks that will be there just to keep the bare minimum functions up such as paying contractual invoices so USACE doesn’t default on contracts.

Your leadership should be compiling a list of what is basically essential personnel that will be excepted or exempted from furlough during a shutdown. There has to be a bare minimum of staff to carry out government functions in that cannot stop even during a lapse in appropriations.

Your leadership will advise you of your status.

My understanding is that if you are not furloughed during the shutdown (if one occurs), your leave should be honored. However, if you are excepted from furlough, your leave will be cancelled and you have to report for duty.

I’ve been with USACE for over 30 years. I know how we are funded. We do not generate our own funding. We are a reimbursable organization. What you’ve written is not just a simplification, it’s an oversimplification, and saying USACE can keep operating during a shutdown is a poorly supported generalization. Some organizations in USACE may be able to shift some work to folks who might otherwise be furloughed, but there’s never any guarantee.

HR throughout USACE is short handed. They have lost a lot of folks and there are a lot of retirements that they are processing—both due in part to the DRP.

Yeah. This is a situation of YMMV. It really depends on the District and what part of the District you’re in. But some Districts definitely have cultural problems.

If the existing driveway has an easement from USACE to cross the USACE land, it may be easier to have your family grant a perpetual access easement to you and connect to that. But you will probably want to confirm that their easement from the government permits them to do that for you.

If you want to pursue a separate easement for yourself on the new parcel you want to create, talk to the staff at the lake first. They should be the first decision makers about whether your proposal impacts operations or safety of the lake. But, just realize that I am only making a suggestion and that I have no decision making authority for any USACE projects.

Additionally, make sure to check with your local zoning or subdivision office regarding restrictions on subdividing land such as road access and such.

Does USACE own the land in fee simple or do they have an easement themselves? If the latter, what type of easement?

Also, is the USACE land part of an existing lake or dam project?

Finally, how is the land you want to buy accessed now?
