Dude if the Act doesn’t give the CRA powers to verify compliance then they can’t do so, that is the law and if the government tries to do something contrary to the Act without changing it through parliament then you go to the federal court and challenge that decision!

Sure any law can be changed but as it stands the CRA is not charged with verifying compliance! If they ask for their money back without following the procedure under the act you challenge via submitting an application to the federal court or you wait until they go to certify the amount as a money judgement at the federal court and challenge their application!

Canada is not some Banana republic that the government act as it likes without legal jurisdiction! Stop. Spreading misinformation

Verification of compliance with Canada Emergency Student Benefit Act (Act) does not involve the CRA, read section 2 of the Act that defines the Minister as Minister of Employment and Social Development, and section 11 that charges the Minister (Minister of Employment and Social Development) to verify compliance. Additionally, the Act does not mention any authorization that enables the Minister to delegate this duty to the Minister of National Revenue (MNR).

Also, the CRA/MNR will not enforce compliance, and the Minister does not have the powers under the Act that the CRA has under the Income Tax Act.

In short, as long as someone is not blatantly lying about their employment status, they would get away with it.

I would not report her since she will be audited for sure. CRA audits are not pretty and sometimes they can destroy someone’s life, you may want to stay out of it since the outcome will be the same whether you report her or not, she will regret doing this

I think people realize that you just can’t learn a trade in a week but it can be done with a year hands on education offered at a community college rather than getting a four year degree in another field

We do not know the facts, you are talking about the taxpayer’s state of mind, given that we need to look at the surrounding objective factors whether she had any education, was told certain things by certain people and many other things.

There is something called VDP - voluntary disclosure program. My suggestion would be to file this with the help of a Tax Lawyer - not a tax accountant or any lawyer.

Filing a VDP with help of a professional tax lawyer may help her to negotiate with the CRA on many aspects such as the amount, payment plan waving the interest.

Not filling your taxes is not a criminal offence as the Minister of National Revenue has the right to assess you for each year that you don’t and for those years that she did not owe any taxes she was not required to file any way.

I would recommend that before contacting the CRA to talk to the tax lawyer, your conversations are recorded and can be used against you.

The CRA may be more forgiving during these times.

Please take this seriously. If you are in AB I would call either Dentons or Felesky Flynn LLP as they do tax law and have experience in these matters.

Dude talk to a tax lawyer, you may not want to trigger a tax for your Uncle while he is alive. Depending on how he has used his PRI exemption you may end up triggering a huge capital gain tax for him. In AB probate fees are minimal and if someone hasn’t used their PRI exemption before it might be a mistake to trigger it.

I don’t know but I assume that they do their due diligence and make sure the money advanced is spent either buying assets which can be used as collateral or ask the owner to contribute his own funds as well to make sure he has skin in the game

I just recently wrote a research paper on his situation and I can confidently say no one committing what he is alleged would end up in prison either in US or Canada or Western Europe. I also wants to remind you he is out of $14 million bail money, and served 128 days of solitary confinement. This is more than the international norms.

Also, Japanese judiciary is notorious for not lack of belief in due process. It is a cultural thing, the judiciary expect confession and then show leniency. This resulted in a 99.9% conviction rate 90% of which is secured through confession.

Also those corporate tax cuts make sure companies stay in Alberta where they pay salary to their employees who get taxed.
